The A-901 Unit oversees the licensing of businesses in the waste and soil and fill industry

A-901 Licensure

Under New Jersey Statute, businesses commercially engaged in the waste industry and in soil and fill recycling services are required to be A-901 licensed with NJDEP.

This includes:​

• solid/medical/hazardous waste transporters​
• solid and hazardous waste brokers​
• solid/hazardous waste facilities​
• anyone who provides provisions of soil and fill recycling services ​

History of A-901

Organized crime and corruption were identified in many industries in New Jersey. The State Commission of Investigation (SCI) was formed in 1968 and confirmed the infiltration of organized criminal elements within the solid waste collection and disposal industry.  The SCI recommended vetting and licensing of all waste haulers to uncover those associated with solid waste collection and disposal companies. In 1983, a law was passed providing for disclosure and investigation of the backgrounds of parties with interest in waste firms.

The law went into effect in 1986 and became known as A-901.

The A-901 Licensing

NJDEP is the licensing agency and works in conjunction with the Office of the Attorney General (OAG) and the NJ State Police to:

• ensure applicants possess the requisite integrity, reliability, expertise and competence to operate in the waste industry or provide provisions of soil and fill recycling;
• and to preclude persons with known criminal records, habits or associations from participation.

About Soil & Fill

Fast forward several decades, the SCI uncovered corruption within the recycling industry.

As a result, the A-901 law was amended in January 2020, to also include A-901 licensing for anyone who provides soil and fill recycling services.

• “soil and fill recycling services” includes the collection, transportation, processing, brokering, storage, purchase, sale or disposition, or any combination thereof, of soil and fill recyclable material
• There is no exemption from the A-901 licensing requirement for entities engaged in soil and fill recycling services that are self-generated.
