The Township of Edison, Middlesex County, New Jersey will be conducting a scoping hearing to discuss the proposed diversion of approximately 0.5 acre of Papaianni Park in connection with the construction of the proposed Edison Sports Building.  The Edison Sports Building would serve as a permanent home for various sports leagues in Edison, such as football, soccer, lacrosse and cheer. Although the building will be a public recreational amenity, construction of the building requires approval as a diversion of parkland because indoor recreation is not allowed on parkland acquired or developed with Green Acres funds. If this application is approved, the proposed diversion area will remain as parkland, but will be classified and encumbered by Green Acres as unfunded parkland.

Pursuant to N.J.A.C. 7:36-26.8, this scoping hearing is being held to solicit public comment on the proposed diversion prior to the Township’s formal filing of a diversion application with the Department of Environmental Protection.

As compensation for the proposed disposal, the Township proposes to dedicate as parkland approximately 12.85 acres of replacement land.  The proposed replacement lands include 10.527 acres of Board of Education-owned land at Lynn Crest School #22 (located at 98 Ira Avenue (Colonia)); 0.679 acre of the Full Gospel Galilee Assembly Church property (located at 52 Clyde Avenue (Hopelawn)); and the entire property (1.646 acres) of the former Ford Avenue School #14 (located at 186 Ford Avenue (Fords)). As compensation for the loss of recreational facilities at Clyde Avenue Park, the Township proposes to place recreational facilities on Mary Fee Lane (to be vacated), the Full Gospel Galilee Assembly Church replacement parcel adjacent to Clyde Avenue Park, at portions of the Fords Middle School property (located at 100 Fanning Street (Fords)) and on the property of the former Ford Avenue School #14.

Proposed Action:

The County of Ocean and the Brick Township Municipal Utilities Authority (MUA) will be conducting a scoping hearing to discuss resolution of an “after the fact” diversion of Green Acres encumbered parkland in connection with the Laurelbrook Wastewater Pump Station Sewer Force Main Emergency Replacement Under the Metedeconk River project (Project).  The Project involved the construction of an underground sanitary sewer force main pipe in an alignment parallel to an existing failed line.  The County now seeks approval to convey to the MUA a permanent easement over a 0.02-acre portion (875 square foot) of Block 755, Lot 35.01 now occupied by the new sewer line.

As compensation for the proposed diversion, the County proposes to accept an equivalent area of replacement land, as an easement, from the MUA within Block 755, Lot 37.02.  Both the proposed diversion area and the proposed replacement land are shown on the map attached to the public hearing notice linked above.

As compensation for both diversions, the Township proposes to dedicate a total of 43.01 acres of replacement as parkland.  Under N.J.A.C. 7:36-26.10(e), the Township may also choose to provide monetary compensation at a minimum 10:1 ratio relative to the market value of the diverted land. All compensation is subject to adjustment based on land valuation requirements.

The proposed replacement land is subject to determination of eligibility as replacement land by the Green Acres Program, pursuant to N.J.A.C. 7:36-26.10(d)2.
