UPDATE – March 22, 2023

  • The applicants have requested, and the Department has granted, a 30-day extension of the time to respond to the Department’s January 31, 2023 pre-application review comments (from March 31, 2023 to April 30, 2023).  Since April 30, 2023 is a Sunday, the Department has informed the applicants that it will accept the response on or before Monday, May 1, 2023.

 

UPDATE – May 3, 2023

On May 1, 2023, the applicants filed a response to the Department’s January 31, 2023 Pre-Application Review Comments.  The response is being posted immediately for the benefit of the public, but is still being reviewed by the Department.

Note (5/4/23):  The version of Exhibit IA-10, Alternatives Analysis Chart, that is attached to several of the above response sections is missing the key for the entries in the “NJDOE Ruling” and “NJDOE Reasons” columns.  A copy of the chart that includes the key may be found here.

UPDATE–Final Public Hearings (updated July 14, 2025 and March 31, 2026)

UPDATE–August 12, 2025–Appraisal Information

Note:  For each parcel, there are two appraisals, one prepared by Associated Appraisal Group (AAG) and one prepared by McNerney & Associates.  The Department has also posted the value that it has accepted for each parcel, as determined by the Department’s appraisal reviewers.  Where the appraisals meet the Department’s appraisal standards and are within 10 percent of each other, the final value is generally determined by averaging the two appraisals.  Where the appraisals meet the Department’s appraisal standards but are more than 10 percent apart, the review appraisers have determined a certified market value in accordance with applicable appraisal review standards and their professional judgment.

 

UPDATE–March 31, 2026–EMS Building Application Approvals and Braddock Park Application Status

On November 18, 2025, the Department approved the Township’s of North Bergen’s application to allow the EMS South Facility to remain on a portion of 43rd Street Park (NJDEP File #SHC0908003).  The application received the approval of the State House Commission on December 15, 2025.  The details of the approval may be found here:  State House Commission Summary

The Department has not taken any formal action on the application by the County of Hudson and the Township of North Bergen to divert a portion of Braddock Park for school purposes.

Scoping Hearing–Township of Edison, Middlesex County–Construction of Indoor Recreation Building on Papaianni Park

Description of Proposed Diversion:

The Township of Edison, Middlesex County, New Jersey will be conducting a scoping hearing to discuss the proposed diversion of approximately 0.5 acre of Papaianni Park in connection with the construction of the proposed Edison Sports Building.  The Edison Sports Building would serve as a permanent home for various sports leagues in Edison, such as football, soccer, lacrosse and cheer. Although the building will be a public recreational amenity, construction of the building requires approval as a diversion of parkland because indoor recreation is not allowed on parkland acquired or developed with Green Acres funds. If this application is approved, the proposed diversion area will remain as parkland, but will be classified and encumbered by Green Acres as unfunded parkland.

Pursuant to N.J.A.C. 7:36-26.8, this scoping hearing is being held to solicit public comment on the proposed diversion prior to the Township’s formal filing of a diversion application with the Department of Environmental Protection.

    1. The proposed disposal of Block 355, Lot 1.01 (0.84 acre) for the construction of a permanent water treatment facility for PFAS removal from the Township’s Well No. 3.
    2. The proposed disposal of Block 500.04, Lot 5 (1.13 acre) for the construction of a permanent water treatment facility for PFAS removal from the Township’s Well No. 4.

Final Hearing–Township of Woodbridge, Middlesex County–Proposed New School on Parkland

Proposed Action:

The Township of Woodbridge is proposing to dispose of 4.429 acres of Clyde Avenue Park in connection with a proposed elementary school. As compensation for the proposed disposal, the Township proposes to dedicate as parkland approximately 12.85 acres of replacement land.  The proposed replacement lands include 10.527 acres of Board of Education-owned land at Lynn Crest School #22 (located at 98 Ira Avenue (Colonia)); 0.679 acre of the Full Gospel Galilee Assembly Church property (located at 52 Clyde Avenue (Hopelawn)); and the entire property (1.646 acres) of the former Ford Avenue School #14 (located at 186 Ford Avenue (Fords)). As compensation for the loss of recreational facilities at Clyde Avenue Park, the Township proposes to place recreational facilities on Mary Fee Lane (to be vacated), the Full Gospel Galilee Assembly Church replacement parcel adjacent to Clyde Avenue Park, at portions of the Fords Middle School property (located at 100 Fanning Street (Fords)) and on the property of the former Ford Avenue School #14.

The New Jersey Department of Environmental Protection has received an application from Union County requesting “after the fact” approval for the 2010 diversion of 0.016 acre of the County’s Rahway River Park for the purpose of expanding an existing underground sewer line easement held by the Township of Springfield to accommodate emergency repairs to the Township’s sewer main.  As compensation for the proposed diversion, the County proposes to accept $10,000 in monetary compensation from the Township.

The New Jersey Department of Environmental Protection has received an application from Union County requesting approval to convey 0.27 acre of easements and 0.02 acre of land in fee simple from parkland known as the Rahway River Parkway (Block 406/Lot 20, Block 2508/Lot 4, Block 3617/Lot 1, Block 908/Lot 16) to the New Jersey Department of Transportation (NJDOT) in connection with the Morris Avenue (Route 82) Bridge replacement over the Rahway River. As compensation for the proposed diversion/disposal, the County proposes to accept $9,000 in monetary compensation from the NJDOT for the proposed easement and fee conveyances, and an additional $518,640 in monetary compensation for tree replacement.

Proposed Action:

The Township of Franklin, Somerset County, has filed a request with the New Jersey Department of Environmental Protection, Office of Transactions and Public Land Administration, proposing to divert a 0.14-acre portion of Castleton Park (Block 383, Lot 43.01) for the purpose of allowing Sunoco Pipeline, LP to install a valve and associated equipment on the existing Sunoco pipeline which traverses the property. To construct the valve and associated equipment, a 0.07-acre temporary surface easement will also be needed.

As compensation for the proposed diversion, the Sunoco Pipeline, LP will provide monetary compensation to the Township, corresponding to ten times the market value of the diverted land (which will be determined by an appraisal). The Township will use these funds for the acquisition of at least 0.56 acre of replacement land within two years of any Department/State House Commission approval.
