Program Regulation

The CO₂ Budget Trading Rule applies to all grid supply fossil fuel electric generating units with a nameplate capacity of 25 megawatts (MW) or greater that commenced operation on January 1, 2005, or later. For the RGGI program, regulation is applied at the electric generation unit basis (EGU), or CO₂ budget source. It is common for a single power plant facility to consist of multiple EGUs. While these units are often part of larger facilities with compliance obligations—including monitoring, reporting, and holding allowances for regulatory compliance—their specific requirements apply to the individual units themselves.

To maintain compliance to the regulation, the CO₂ budget source’s Title V operating permit must contain all applicable requirements of the CO₂ budget program, including monitoring, record keeping and reporting.

All regulated entities must submit the “RGGI Certificate of Representation Form to the U.S. EPA Clean Air Markets Data Program which will be reflected in the RGGI CO₂ Allowance Tracking System (COATS).[/vc_column_text][/vc_column][/vc_row][vc_row][vc_column][vc_column_text css=””]

Program Management

The Department’s Air, Energy, and Materials Sustainability Program reviews and approves all permit applications and revisions. The Bureau of Climate Change and Clean Energy (BCCCE) manages the program implementation, coordinates with RGGI, Inc. on the auction requirements and monitoring, and oversees the investment of auction proceeds.

Program Requirements

New Jersey’s RGGI rule requires the following from regulated entities:

Application for adding CO₂ Budget Source in Operating Permit

Consistent with N.J.A.C. 7:27C-3.3, a CO₂ budget source must submit NJ03-APPLICATION FOR ADDING A CO2 BUDGET SOURCE IN OPERATING PERMIT , along with a complete application for a new, renewed, or modified operating permit.

Compliance Plan

Consistent with N.J.A.C. 7:27C-8, the CO₂ budget source and each CO₂ budget unit at the source must comply with the monitoring, record keeping, and reporting requirements of the CO₂ Budget Trading Program at N.J.A.C. 7:27C, as applicable. Pursuant to N.J.A.C. 7:27-22.28, the Department will incorporate these requirements into the facility’s operating permit using the Compliance Plan Template .

Electronic Submission of RGGI Reports

DEP now requires all reports under the RGGI program to be submitted electronically through the Registered Services Portal (RSP) at https://www.njdeponline.com/. If you are a new user, please create an account under Registered Services. Instructions to using this service .

Please use these services to submit the following reports:

  • Quarterly Reports, on or before every April 30, July 30, October 30 and January 30 for the preceding quarter year.
  • Annual Report, by March 1st of every year
  • Compliance Certification Report, by March 1st every three years, at the end of a control period
  • Emissions Monitoring Report, by March 1st of the year of joining the RGGI program
  • Output Monitoring Report, by March 1st of the year of joining the RGGI program
  • Documents can be in ‘pdf’ or ‘doc’ format and should be ready for upload when initiating the submission. Please make sure that the Quarterly Report is submitted for the correct quarter.

Compliance Certification

NJ RGGI EGU Current and Historic Emissions Dashboard

This dashboard displays locational information for each power plant electric generating unit (EGU) subject to the Regional Greenhouse Gas Initiative, as well as historic annual emissions and operational information. This display does not include units previously subject to RGGI that have retired prior to the current calendar year.
