STANDARDS FOR THE MANAGEMENT OF USED OIL
Has used oil mixed with a listed hazardous waste been managed as a hazardous waste? [N.J.A.C. 7:26A-6.1(a)2i(1)]
Has used oil mixed with a characteristic hazardous waste been managed as a hazardous waste. [N.J.A.C. 7:26A-6.1(a)2ii(1)]
Did the used oil generator comply with the management requirements for diesel fuel mixed with used diesel crankcase oil. [N.J.A.C. 7:26A-6.1(a)4ii]
Did the marketer or burner comply with requirements of 40 C.F.R. 761.20(e) for used oil containing quantifiable levels of PCBs. [N.J.A.C. 7:26A-6.1(a)9]
Did used oil burned for energy recovery meet the specifications listed in N.J.A.C. 7:26A-6.2(a)? [N.J.A.C. 7:26A-6.2(a)]
Did the facility have a permit to construct, install or alter control apparatus or equipment and certificate to operate control apparatus or equipment or other required authorization prior to burning on-specification used oil fuel? [N.J.A.C. 7:26A-6.2(b)]
Did the facility comply with the requirements for managing used oil in a surface impoundment or waste pile. [N.J.A.C. 7:26A-6.3(a)]
Was the used oil being used as a DUST SUPPRESSANT? [N.J.A.C. 7:26A-6.3(b)]
Did the burner burn off-specification used oil in a device other than an industrial furnace, industrial or utility boiler or hazardous waste incinerator, or fail to obtain a “Permit to Construct, Install or Alter Control Apparatus or Equipment and Certificate to Operate Control Apparatus” prior to burning off-specification used oil in one of these devices? Did the facility comply with the prohibition against burning on-specification used oil fuel in either a residential or Category I institutional device, furnace or boiler? [N.J.A.C. 7:26A-6.3(d)]
Did the generator BURN on-specification used oil in a used oil-fired space heater designed to have a maximum capacity of not more than 0.5 million BTU per hour? [N.J.A.C. 7:26A-6.3(e)]
Did the generator BURN off-specification used oil in a space heater? [N.J.A.C. 7:26A-6.3(f)]
USED OIL TRANSPORTER REQUIREMENTS
Did the used oil transporter conduct non-incidental processing of used oil? [N.J.A.C. 7:26A-6.6(b)]
Did used oil transporter obtain an EPA identification number and comply with the requirements of N.J.A.C. 7:26A-6.6? [N.J.A.C. 7:26A-6.6(c)1]
Did used oil transporter which had not received an EPA identification number obtain one by notifying the USEPA Region II of its used oil activity by submitting either: i. A completed EPA Form 8700-12 (To obtain ordering information for EPA Form 8700-12 call RCRA Superfund Hotline at 1-800-424-9346 or 703-920-9810); or ii. A letter requesting an EPA identification number. Call the RCRA Superfund Hotline to determine where to send a letter requesting an EPA identification number. The letter should include the following: (1) The transporter company name; (2) The owner of the transporter company; (3) The mailing address for the transporter, (4) The name and telephone number for the transporter point of contact; (5) The type of transport activity (that is, transport only, transport and transfer facility, transfer facility only); (6) The location of all transfer facilities at which used oil is stored; and (7) The name and telephone number for a contact at each transfer facility; and. Did the used oil transporter have an EPA identification number? [N.J.A.C. 7:26A-6.6(c)]
Did used oil transfer facility notify the Department in writing of the location of the transfer facility prior to conducting any used oil activities at the transfer facility? Was the notification mailed to the New Jersey Department of Environmental Protection, Waste Compliance and Enforcement and Release Prevention, Bureau of Hazardous Waste Compliance and Enforcement, PO Box 407, Mail code 09-03, Trenton, New Jersey 08625-0407? [N.J.A.C. 7:26A-6.6(c)3]
Did the transporter off-load all used oil received at or to: another used oil transporter, with an EPA ID number; a used oil processing/re-refining facility with an EPA ID number; an off-specification used oil burner facility with an EPA ID number; or an on-specification used oil burner facility. [N.J.A.C. 7:26A-6.6(d)1]
Did the transporter comply with all applicable requirements under the USDOT regulations in 49 C.F.R. 171-180. [N.J.A.C. 7:26A-6.6(d)2]
Did the used oil transporter comply with used oil transportation discharge requirements? [N.J.A.C. 7:26A-6.6(d)3]
Did the transporter determine the halogen content of the used oil? [N.J.A.C. 7:26A-6.6(e)1]
Did the used oil transporter ensure that used oil is not a hazardous waste under the rebuttable presumption of N.J.A.C. 7:26A-6.1(a)2i(2), by: i. testing the used oil; or ii. applying knowledge of the halogen content or the used oil in light of the materials or processes used? [N.J.A.C. 7:26A-6.6(e)2]
Did the owner or operator rebut the presumption by demonstrating that the used oil does not contain hazardous waste (for example, by using an analytical method from SW-846, Edition III, or later) to show that the used oil does not contain significant concentrations of halogenated hazardous constituents listed in Appendix VIII of 40 C.F.R. Part 261, as incorporated by reference at N.J.A.C. 7:26G-5? [N.J.A.C. 7:26A-6.6(e)3]
Did the used oil transporter maintain the analysis or information for at least three years? [N.J.A.C. 7:26A-6.6(e)5]
Did the transporter keep a record of each used oil shipment accepted for transport? [N.J.A.C. 7:26A-6.6(g)]
All collected solid waste shall be properly deposited at an approved facility in accordance with N.J.A.C. 7:26-1 and 2. Solid waste or recyclable materials shall be deposited at a solid waste or recycling facility only to the extent the materials contained in an individual load are waste types and recyclables permitted for acceptance at that facility and commingled only to the extent permitted in the operating approvals for that facility.
