Notice of Proposed Readoption with Substantive Changes
Fund Procedures and Requirements, N.J.A.C. 7:22-3

PUBLIC NOTICE

Take notice that the New Jersey Department of Environmental Protection (Department) is proposing to readopt N.J.A.C. 7:22-3, Fund Procedures and Requirements, with substantive changes. The rules at N.J.A.C. 7:22-3 were scheduled to expire on December 10, 2025. As the Department filed the readoption with substantive changes with the Office of Administrative Law prior to that date, the expiration date was extended for 180 days to June 8, 2026, pursuant to N.J.S.A. 52:14B-5.1c(2).

The rules proposed for readoption with substantive changes establish the policies and procedures by which the Department provides financing for the construction of wastewater treatment, water supply, and stormwater/nonpoint source management facilities. Department financing is administered in partnership with the New Jersey Infrastructure Bank, which together form the New Jersey Environmental Infrastructure Financing Program to administer New Jersey’s Clean Water State Revolving Fund and Drinking Water State Revolving Fund. N.J.A.C. 7:22-3 would be modified to incorporate amendments reflective of new and amended State and Federal law requirements and program procedures and policies.
