Notice of Rule Proposal

General Practice and Procedures N.J.A.C. 7:1D

Public Notice

Take notice that the NJ Department of Environmental Protection (Department) is proposing to readopt the General Practices and Procedures rules, N.J.A.C. 7:1D. In accordance with N.J.S.A. 52:14B-5.1, the Department of Environmental Protection (Department) proposes to readopt the rules at N.J.A.C. 7:1D, which were scheduled to expire on June 7, 2025. As the Department submitted this notice of proposal to the Office of Administrative Law prior to that date, the expiration date was extended 180 days to December 4, 2025, pursuant to N.J.S.A. 52:14B-5.1c(2).

The rules proposed for readoption establish, pursuant to Subchapter 1, the procedure for the public to petition the Department for rulemaking; pursuant to Subchapter 2,  govern the debarment, suspension, or disqualification of persons from contracting with the Department; pursuant to Subchapter 3, establish categories of records identified by the Department as non-public and not subject to disclosure pursuant to the Open Public Records Act (OPRA); and pursuant to Subchapter 5, establish the circumstances through which the Department will extend the public comment period on a rule proposal and hold a public hearing on a rule proposal and the means by which it will provide notice of rulemaking to the public. N.J.A.C. 7:1D Appendix A sets forth the Department’s “Mapping and Digital Data Standards,” which set forth the technical standards for the development of digital maps that are submitted to the Department.
