{"id":479,"date":"2024-08-07T16:13:20","date_gmt":"2024-08-07T20:13:20","guid":{"rendered":"https:\/\/deptest.nj.gov\/wastecompliance\/?page_id=479"},"modified":"2025-11-12T10:11:56","modified_gmt":"2025-11-12T15:11:56","slug":"recycling-center-class-c-recyclables-inspection-checklist","status":"publish","type":"page","link":"https:\/\/deptest.nj.gov\/wastecompliance\/recycling\/recycling-center-class-c-recyclables-inspection-checklist\/","title":{"rendered":"Recycling Center: Class C Recyclables &#8211; Inspection Checklist"},"content":{"rendered":"<p>[vc_row][vc_column][vc_column_text css=&#8221;&#8221;]Most Class C facilities have an approval and site-specific checklist.\u00a0 Below is a portion of the generic checklist we utilize.<\/p>\n<h3>RECYCLING CENTERS &#8211; GENERAL REQUIREMENTS<\/h3>\n<p>Is Class B, Class C and\/or Class D recycling center complying with all approval conditions? \u00a0[N.J.A.C. 7:26A-3.1]<\/p>\n<p>Did recycling center obtain prior written approval from the Department for the receipt, storage, processing or transfer of Class B, Class C or Class D, recyclable material?\u00a0 Note:\u00a0 A facility operating without such approval is considered to be operating an unlicensed solid waste facility and is subject to penalties as set forth in N.J.S.A. 13:1E-9 and N.J.A.C. 7:26-5 in addition to penalties which may be assessed by other regulatory agencies pursuant to their authority. That person may also be subject to penalties for violations of any other Department rules and the statutes under which such rules are promulgated. [N.J.A.C. 7:26A-3.1(b)]<\/p>\n<p><strong>APPROVAL RENEWAL REQUIREMENTS<\/strong><\/p>\n<p>Did facility submit renewal application for a general approval at least three months prior to expiration of the current approval and did it comply with all requirements for renewal set forth in this subchapter?\u00a0 Was one copy of the renewal application submitted to the municipal clerk of the municipality in which the recycling center is located and another submitted to the solid waste or recycling coordinator of the county in which the recycling center is located? \u00a0[N.J.A.C. 7:26A-3.6(a)]<\/p>\n<p>Did recycling center not receive Class B, Class C or Class D recyclable material and commence operation until it had received written approval from the Department? \u00a0[N.J.A.C. 7:26A-3.6(g)]<\/p>\n<p>Did\u00a0 facility obtain prior approval from the Department for any modification of the general or limited approval? \u00a0[N.J.A.C. 7:26A-3.10(a)]<\/p>\n<p>Did recycling center not transfer general or limited approval to operate to a new owner or operator without the Department&#8217;s prior approval? \u00a0[N.J.A.C. 7:26A-3.15(a)]<\/p>\n<p>Was one copy of the application to transfer a general or limited approval submitted to the municipal clerk of the municipality in which the recycling center is located and was one copy submitted to the solid waste or recycling coordinator of the county in which the recycling center is located?\u00a0 Note: The Department shall notify county and municipal officials of determinations concerning the transfer of general or limited approvals. [N.J.A.C. 7:26A-3.15(c)]<\/p>\n<p><strong>REQUIREMENTS FOR RECORDKEEPING AND ANNUAL REPORTS<\/strong><\/p>\n<p>Does facility maintain the following records? 1. A daily record of the amounts of each recyclable material by type and municipality of origin which are received, stored, processed or transferred each day, expressed in tons, cubic yards, cubic feet or gallons. Those operators specifying this information in cubic yards shall also indicate the conversion ratio of the materials from cubic yards to tons;\u00a0 2. The name, address and telephone number of the end-markets for all recyclable materials transported from the recycling center, including the amounts, in tons, cubic yards, cubic feet or gallons, transported to each end-market. Those persons specifying this information in cubic yards shall also indicate the conversion ratio of the materials from cubic yards to tons; and\u00a0 3. The amount of residue disposed of, expressed in tons, cubic yards, cubic feet or gallons, including the name and New Jersey Department of Environmental Protection solid waste registration number of the solid waste collector\/hauler contracted to provide the haulage\/disposal service. Those persons specifying the amount of residue in cubic yards shall also indicate the conversion ratio of the residue from cubic yards to tons. [N.J.A.C. 7:26A-3.17(a)]<\/p>\n<p>Note: As a condition of approval to operate a recycling center for the receipt, storage, processing or transfer of Class B, Class C or Class D recyclable materials, the Department may require the filing of the information required in N.J.A.C. 7:26A-3.17(a) at more frequent intervals which shall be specified in the general approval to operate a recycling center issued by the Department. [N.J.A.C. 7:26A-3.17(d)]<\/p>\n<p>Does facility certify in writing to the Department that all residue generated at the recycling center has been disposed of in accordance with the solid waste management rules at N.J.A.C. 7:26 and was this certification submitted annually as part of the annual report required pursuant to N.J.A.C. 7:26A-3.17(c) and (d)? \u00a0[N.J.A.C. 7:26A-3.17(e)]<\/p>\n<p>Note: All information submitted to the Department pursuant to this chapter shall be handled in accordance with the requirements of the Public Records law, N.J.S.A. 47:1-1 et seq. The Department will hold confidential and end-market information, as well as information pertaining to the municipality of origin of recyclable material, submitted pursuant to N.J.A.C. 7:26A-3.2, 3.7, and 3.17 through 3.20 for a period of two years from the date on which the information is submitted to the Department, where specified as confidential by the applicant and where there are no health, safety or environmental concerns which require the release of the information, as determined by the Department. [N.J.A.C. 7:26A-3.17(f)]<\/p>\n<p><strong>RECYCLING CENTERS &#8211; GENERAL OPERATIONAL STANDARDS<\/strong><\/p>\n<p>Does facility comply with the following operational standards:\u00a0 1. All recyclable materials received, stored, processed or transferred at all recycling centers shall conform to the following criteria:\u00a0 i. The recyclable materials shall have been separated at the point of generation from other waste materials or separated at a permitted solid waste facility authorized to separate recyclable materials from the incoming waste stream;\u00a0 ii. The recyclable materials shall consist only of Class A recyclable materials, or of Class B, or Class C or Class D recyclable materials which the Department has approved pursuant to N.J.A.C. 7:26A-3 for receipt, storage, processing or transfer at the recycling center; and\u00a0 iii. Class A recyclable materials may be commingled only with other Class A recyclable materials. Class B recyclable materials may be commingled only with other Class B recyclable materials and only to the extent authorized in the general or limited approval issued pursuant to N.J.A.C. 7:26A-3.5 or 3.7. Class C recyclable materials may be commingled only with other Class C recyclable materials and only to the extent authorized in the general approval issued pursuant to N.J.A.C. 7:26A-3.5. [N.J.A.C. 7:26A-4.1(a)1]<\/p>\n<p>Does recycling center ensure that recyclable material is separated at the point of generation from other waste material? \u00a0[N.J.A.C. 7:26A-4.1(a)1i]<\/p>\n<p>Did recycling center ensure only Class A, Class B or Class C materials were received, stored, processed or transferred at the center? \u00a0[N.J.A.C. 7:26A-4.1(a)1ii]<\/p>\n<p>Did recycling center comply with commingling requirements? \u00a0[N.J.A.C. 7:26A-4.1(a)1iii]<\/p>\n<p>Does facility store residue on-site for not more than six months? \u00a0[N.J.A.C. 7:26A-4.1(a)2]<\/p>\n<p>Does facility remove all residue from the recycling center site in accordance with each district&#8217;s waste plan? \u00a0[N.J.A.C. 7:26A-4.1(a)3]<\/p>\n<p>Is the residue stored separately and in a manner which prevents run-off, leakage or seepage? \u00a0[N.J.A.C. 7:26A-4.1(a)4]<\/p>\n<p>Does the facility not receive, store, process or transfer hazardous waste, as defined in N.J.A.C. 7:26, except for used oil and universal waste as provided pursuant to N.J.A.C. 7:26A-4.7, 6 and 7? \u00a0[N.J.A.C. 7:26A-4.1(a)5]<\/p>\n<p>Does the facility not shred, shear or bale capacitors or electronic components which contain polychlorinated biphenyls (PCBs) which are attached to, or detached from, appliances or other scrap metal? \u00a0[N.J.A.C. 7:26A-4.1(a)6]<\/p>\n<p>Is the facility operating in conformance with all applicable Federal, State and local rules? \u00a0[N.J.A.C. 7:26A-4.1(a)7]<\/p>\n<p>Is the facility operating in such a manner that it is free of litter, debris and prevents tracking of mud off site? \u00a0[N.J.A.C. 7:26A-4.1(a)8]<\/p>\n<p>Note: All recycling centers located within the Pinelands Protection Area shall be operated in a manner consistent with the goals of the comprehensive management plan developed by the Pinelands Commission pursuant to the Pinelands Protection Act, N.J.S.A. 13:18A-1 et seq., and shall obtain all approvals required by the Pinelands Commission. [N.J.A.C. 7:26A-4.1(a)9]<\/p>\n<p>Note: The construction of all recycling centers shall be in conformance with the New Jersey Uniform Construction Code, N.J.S.A. 52:27D-119 et seq., and the rules promulgated pursuant thereto. [N.J.A.C. 7:26A-4.1(b)]<\/p>\n<p>Note: No recycling center, as defined in N.J.A.C. 7:26A-1.3, with the exception of those recycling centers operating pursuant to an approval granted under N.J.A.C. 7:26A-3.7, shall commence operations unless and until it is included in the applicable district solid waste management plan. [N.J.A.C. 7:26A-4.2]<\/p>\n<p>Did facility allow the New Jersey Department of Environmental Protection or an authorized representative acting pursuant to the County Environmental Health Act, N.J.S.A. 26:3A2-1 et seq. to enter and inspect any building or other portion of a recycling center, recycling depot or any site at which an exempted activity is conducted pursuant to N.J.A.C. 7:26A-1.4(a), at any time in order to determine compliance with the provisions of all applicable laws or rules and regulations adopted pursuant thereto?\u00a0 This right to inspect includes, but is not limited to: 1. Sampling any materials on site;\u00a0 2. Photographing any portion of the recycling center;\u00a0 3. Investigating an actual or suspected source of pollution of the environment and\u00a0 4. Ascertaining compliance or non-compliance with the statutes, rules or regulations of the Department, including conditions of the recycling center approval issued by the Department. [N.J.A.C. 7:26A-4.3(a)]<\/p>\n<p>Note: The right of entry specified in N.J.A.C. 7:26A-3(a) shall be limited to normal operating hours for the purpose of reviewing and copying all applicable records, which shall be made available to the Department during an inspection and submitted to the Department upon request. [N.J.A.C. 7:26A-4.3(b)]<\/p>\n<p>Note: In an enforcement action, or on specific request of the Department, persons claiming that they qualify for any exclusion or exemption in this chapter or that they are not otherwise subject to the rules in this chapter shall demonstrate and appropriately document that they satisfy all terms of the law releasing them from the requirements of this chapter. [N.J.A.C. 7:26A-1.5(a)]<\/p>\n<p>Does recycling center operator ensure that traffic associated with the operation of the center does not result in a degradation of a level of service of any major intersection or public roadway within a half-mile radius? \u00a0[N.J.A.C. 7:26A-4.1(a)10]<\/p>\n<p>Are recycling center operations separated from any and all adjacent residential, commercial and\/or other sensitive land uses through the establishment of an effective visual screen buffer? \u00a0[N.J.A.C. 7:26A-4.1(a)11]<\/p>\n<p>Is the entrance to the access road fenced or otherwise secured to prevent unauthorized access to the site? \u00a0[N.J.A.C. 7:26A-4.1(a)12]<\/p>\n<p>Are those areas of the recycling center subject to vehicular usage suitably compacted and where necessary paved to provide sufficient support for vehicles, to prevent the tracking of soil onto public roads and to minimize the generation of dust? \u00a0[N.J.A.C. 7:26A-4.1(a)13]<\/p>\n<p>Is adequate water supply and fire-fighting equipment readily available to extinguish any fires?\u00a0 Is the telephone number of the local fire department posted at the entrance to the recycling center? \u00a0[N.J.A.C. 7:26A-4.1(a)14]<\/p>\n<p>Did Class B, Class C or Class D recycling center not receive, store, process or transfer material until receiving written Department approval?\u00a0 Is facility operating in compliance with all conditions of the approval? \u00a0[N.J.A.C. 7:26A-3.1(a)]<\/p>\n<p>Did Class B, Class C or Class D recycling center not receive, store, process or transfer material until receiving written Department approval?\u00a0 Is facility operating in compliance with all conditions of the approval?<\/p>\n<p><strong>CLASS C RECYCLING CENTER &#8211; ADDITIONAL DESIGN AND OPERATIONAL REQUIREMENTS<\/strong><\/p>\n<p>Is the Class C recycling center accepting yard trimmings not located on land which had been purchased with money from any Green Acres bond act or which is designated as land for recreation and conservation purposes and listed in the Green Acres recreational land inventory? \u00a0[N.J.A.C. 7:26A-4.5(a)1]<\/p>\n<p>Is recycling center operation under the supervision and control of a properly trained individual during all hours of operation, and is access to the recycling center prohibited when the recycling center is closed? \u00a0[N.J.A.C. 7:26A-4.5(a)3]<\/p>\n<p>Did operator accept grass only in areas of the site that are at least 1,000 feet from any areas of human use or occupancy, and begin processing of such material on the day of receipt? \u00a0[N.J.A.C. 7:26A-4.5(a)6]<\/p>\n<p>Did Class C yard trimming operator to comply with material staging and processing buffer distance requirements; Specifically;\u00a0 1) The minimal level of technology is a 2500 foot buffer, with leaves, from operations to sensitive land uses. 2) The low level of technology is 50\/500 foot buffer, with leaves, from operations to property line \/ sensitive land uses. 3) The intermediate level of technology is a 50\/150\/250 foot buffer, with leaves, from operating to property line\/ sensitive land uses \/ to inhabited structure, and 1000 foot buffer with grass from grass clipping staging and handling areas to sensitive land uses. 4) The level of technology is a 50 foot buffer, with leaves, building setback for enclosed operation. [N.J.A.C. 7:26A-4.5(a)7vii]<\/p>\n<p>Did Class C yard trimming operator to comply with finished compost testing requirements? \u00a0[N.J.A.C. 7:26A-4.5(a)7viii]<\/p>\n<p>Did Class C yard trimming operator to comply with additional recordkeeping requirements; specifically; (1) The results of compost analyses and name(s) of certified laboratory(ies); (2) The quantity, type and source of incoming material; (3) The quantity and types of recovered recyclables; (4) The quantity of disposed residue, and sites receiving residue; and (5) The standard procedures employed to ensure data reliability. [N.J.A.C. 7:26A-4.5(a)7xii]<\/p>\n<p>Did the recycling center notify the Department in writing at least 60 days prior to the proposed closure date for the recycling center? \u00a0[N.J.A.C. 7:26A-4.5(a)9]<\/p>\n<p>Does the operator prohibit access to the site when it is closed? \u00a0[N.J.A.C. 7:26A-4.5(a)10]<\/p>\n<p><strong>CLASS C &#8211; ANNUAL FEE REQUIREMENTS<\/strong><\/p>\n<p>Did Class C recycling center with general approval pay annual fee of within 30 days of billing? \u00a0[N.J.A.C. 7:26A-2.1(b)2]<\/p>\n<p>Did Class C recycling center with general approval pay required compliance monitoring annual fee? \u00a0[N.J.A.C. 7:26A-2.1(c)]<\/p>\n<p><strong>ADDITIONAL OPERATIONAL AND DESIGN REQUIREMENTS FOR CLASS C RECYCLING CENTERS RECEIVING MATERIALS OTHER THAN OR IN ADDITION TO YARD TRIMMINGS<\/strong><\/p>\n<p>Does the facility have sufficient capacity to handle projected incoming volumes of Class C recyclable material? \u00a0[N.J.A.C. 7:26A-4.5(b)1]<\/p>\n<p>Does the composting structure withstand normal wear and tear; is the floor impermeable, is ponding prevented, and is leachate directed\u00a0 to a required leachate collection system? \u00a0[N.J.A.C. 7:26A-4.5(b)2]<\/p>\n<p>Is the recycling center operation fully enclosed except in those cases where vegetative food material is the only food material received? \u00a0[N.J.A.C. 7:26A-4.5(b)3]<\/p>\n<p>Is the recycling center fully enclosed and does it meet the buffer requirements for recycling centers handling grass clippings? \u00a0[N.J.A.C. 7:26A-4.5(b)4]<\/p>\n<p>Is the (O&amp;M) manual specific to the recycling center, updated as needed, and available at the recycling center for inspection by Department? Does the O&amp;M manual\u00a0 include any and all information to enable supervisory and operating personnel to determine the sequence of operations, routine maintenance schedules, plans, policies, procedures, and legal requirements that must be adhered to, as well as a quality assurance\/quality control (QA\/QC) plan which outlines the monitoring, sampling and analysis plans for testing the compost process and product? \u00a0[N.J.A.C. 7:26A-4.5(b)5]<\/p>\n<p>Is recycling center operation under the supervision and control of a properly trained individual during all hours of operation? \u00a0[N.J.A.C. 7:26A-4.5(b)9]<\/p>\n<p>Does the operator prohibit access to the site when it is closed? \u00a0[N.J.A.C. 7:26A-4.5(b)10]<\/p>\n<p>Does the operator not mix incoming, unprocessed material with finished compost? \u00a0[N.J.A.C. 7:26A-4.5(b)12]<\/p>\n<p>Does the operator ensure that pathogens are reduced using one of the following approved methods: i. Windrow method, which meets PFRP as follows:\u00a0 (1) Maintenance of aerobic conditions; and (2) A minimum of five turnings over 15 consecutive days, maintaining a temperature of not less than 55 degrees Celsius (131 degrees Fahrenheit). ii. Aerated static pile method, which meets PFRP as follows: (1) Pile insulated with six to 12 inches of insulating material (for example, sawdust, cured compost, or wood chips); and (2) Temperature of at least 55 degrees Celsius (131 degrees Fahrenheit) maintained throughout the mixture for three consecutive days; or iii. Enclosed (within) vessel composting method, which meets PFRP as follows:\u00a0 (1) Temperature maintained at 55 degrees Celsius (131 degrees Fahrenheit) throughout the mixture for at least three consecutive days. [N.J.A.C. 7:26A-4.5(b)13]<\/p>\n<p>Does the recycling center monitor the temperature of the material in the composting process to ensure that pathogen reduction criteria are met and are the temperature readings recorded daily during PFRP? \u00a0[N.J.A.C. 7:26A-4.5(b)14]<\/p>\n<p>Does the design capacity of the finished compost storage area not exceed 15 months of production, in accordance with the marketing plan prepared and submitted in accordance with N.J.A.C. 7:26A-3? \u00a0[N.J.A.C. 7:26A-4.5(b)15]<\/p>\n<p>Does the facility store finished compost at the recycling center for a term not exceeding 15 months? \u00a0[N.J.A.C. 7:26A-4.5(b)16]<\/p>\n<p>Does the operator remove compost stored at the center within 15 months as required? \u00a0[N.J.A.C. 7:26A-4.5(b)17]<\/p>\n<p>Note: The Department shall establish an appropriate monitoring and sampling schedule for a one-year start-up period as part of the recycling center approval. [N.J.A.C. 7:26A-4.5(b)18]<\/p>\n<p>Note: Using information gained during the one-year start-up period, a monitoring and sampling schedule for ongoing operations shall be developed, as part of the recycling center approval, in consultation with the Department based on statistical methods for quality assurance. [N.J.A.C. 7:26A-4.5(b)19]<\/p>\n<p>Are compost samples obtained in accordance with the approved QA\/QC plan and are these samples analyzed for the compost quality monitoring parameters listed in Appendix A in accordance with the appropriate methods as approved in the sampling plan?\u00a0 Are the results of all laboratory analysis for each parameter specified in Appendix A recorded and maintained at the facility? Are quality assurance results reported to the Department pursuant to N.J.A.C. 7:26A-4.5(b)23? \u00a0[N.J.A.C. 7:26A-4.5(b)20]<\/p>\n<p>Is the facility using a laboratory to perform the analysis of the finished compost product which is certified in accordance with N.J.A.C. 7:18 for the equipment and testing procedures required pursuant to N.J.A.C. 7:26A-4.5(b)20. [N.J.A.C. 7:26A-4.5(b)21]<\/p>\n<p>Does the recycling center shall maintain the following records: i. Daily temperature and moisture monitoring of the composting process; ii. The quantity of material received daily expressed as cubic yards; iii. The source of material received daily; iv. The results of laboratory analyses of finished compost; v. The retention time of the finished compost; and vi. The sale and distribution of recovered materials. [N.J.A.C. 7:26A-4.5(b)22]<\/p>\n<p>Are quarterly reports submitted to the Department within 30 days after the end of each calendar quarter which include the following information: i. Results of compost analyses and name(s) of certified laboratory(ies); ii. The quantity, type and source of incoming materials; iii. The quantity and types of recovered recyclables; iv. The quantity of compost produced; v. The quantity of compost sold and\/or distributed, and the end markets to which the compost is sold or distributed; vi. The quantity of disposed residue, and sites receiving residue; vii. Daily temperature readings and retention times during PFRP; viii. A summary of leachate management (collected and reused or treated and disposed); ix. A summary of major maintenance on leachate, temperature or other monitoring and control systems in operation; and x. The standard procedures employed to ensure data reliability. [N.J.A.C. 7:26A-4.5(b)23]<\/p>\n<p>Did the facility after one year of approval submit to the Department a final closure plan containing a schedule and description of the steps necessary to close the recycling center including the estimated cost of closure and the plans to finance? \u00a0[N.J.A.C. 7:26A-4.5(b)24]<\/p>\n<p>Did the operator submit an update to the final closure plan as needed in writing at least 180 days prior to the proposed closure date for the recycling center? \u00a0[N.J.A.C. 7:26A-4.5(b)25]<\/p>\n<p>Did the recycling center notify the Department in writing at least 60 days prior to the proposed closure date for the recycling center? \u00a0[N.J.A.C. 7:26A-4.5(b)26]<\/p>\n<p>Did the recycling center publish at least 30 days prior to closure a notice of closure in a newspaper of general circulation in the district where the recycling center is located and in districts or communities sending at least 25 percent of their Class C recycling material to the recycling center. [N.J.A.C. 7:26A-4.5(b)27]<\/p>\n<p>Within 10 days of ceasing operation, were all residuals and unprocessed Class C recyclable material removed from the site and recycled or disposed, as appropriate, and did the recycling center arrange for a final cleaning of any containers, equipment, machines, floors and recycling center surfaces in which Class C recyclable materials or residue was processed or stored? \u00a0[N.J.A.C. 7:26A-4.5(b)28]<\/p>\n<p>Note: The Department shall determine that a recycling center is closed when all of the requirements of the closure plan have been met. [N.J.A.C. 7:26A-4.5(b)29]<\/p>\n<p>Is the facility complying with all requirements necessary for compost given away or offered for sale, specifically: 1. Compost must contain a label describing the recommended safe uses and application rates, and restrictions, if any, on use of the product. If compost is offered for bulk sale, signs or printed literature containing the above information shall be available on the bill of lading to the purchaser or persons receiving the compost.\u00a0 2. Compost given away or offered for sale shall satisfy the general requirements established at 40 C.F.R. Part 503, specifically 40 C.F.R. 503.13(b)(3), the Class A pathogen requirements in 40 C.F.R. 503.32(A), and one of the vector attraction reduction requirements in 40 C.F.R. 503.33(b)(1) through 503.33(b)8. [N.J.A.C. 7:26A-4.5(c)]<\/p>\n<p>Did Class C operator comply with labeling requirements? \u00a0[N.J.A.C. 7:26A-4.5(c)1]<\/p>\n<p>Did Class C operator comply with compost utilization requirements? \u00a0[N.J.A.C. 7:26A-4.5(c)2]<\/p>\n<p><strong>RECYCLED MATERIALS &#8211; BURDEN OF PROOF<\/strong><\/p>\n<p>Note: In an enforcement action, or on specific request of the Department, persons claiming that a certain material is not a recyclable material shall demonstrate and appropriately document that the material is not recyclable and that there is an approved alternate use for the material. [N.J.A.C. 7:26A-1.5(b)]<\/p>\n<p><strong>CLASS C &#8211; GENERAL REQUIREMENTS<\/strong><\/p>\n<p>Does operator of mobile recycling processing equipment for Class B, Class C or Class D recyclable material comply with all applicable statutes and regulations, including, but not limited to, the New Jersey Air Pollution Control Act, N.J.S.A. 26:2C-1 et seq. and 26:2D-1 et seq., and the New Jersey Noise Control Act of 1971, N.J.S.A. 13:1G-1 et seq? \u00a0[N.J.A.C. 7:26A-3.3(b)]<\/p>\n<p>Is the facility retaining all information required pursuant to NJAC 7:26A-3.2(a)16iii for three calendar years following the calendar year for which reporting is required pursuant to NJAC 7:26A-3.17(c) and (d)? \u00a0[N.J.A.C. 7:26A-3.17(b)]<\/p>\n<p>Did facility submit an annual report containing monthly summary statements of the information required pursuant to N.J.A.C. 7:26A-3.17(a) to the New Jersey Department of Environmental Protection, Division of Solid and Hazardous Waste, on or before March 1 of each year, for the previous calendar year? \u00a0[N.J.A.C. 7:26A-3.17(c)]<\/p>\n<p>Is the facility operating in conformance with all applicable Federal, State, county, municipal, and other local laws and regulations including, but not limited to, nuisance codes, the noise control rules at N.J.A.C. 7:29, the air pollution control rules at N.J.A.C. 7:27, the stream encroachment rules at N.J.A.C. 7:13, the New Jersey Pollutant Discharge Elimination System (NJPDES) rules at N.J.A.C. 7:14A, the Soil Erosion and Sediment Control Act, N.J.S.A. 4:24-1 et seq., and with all applicable fire and safety codes? \u00a0[N.J.A.C. 7:26A-4.1(a)7]<\/p>\n<p>Did facility provide a recycling tonnage report by February 1 of each year to the county of origin (if requested) and all municipalities from which recyclable material was received in the previous calendar year? \u00a0[N.J.A.C. 7:26A-4.4(a)]<\/p>\n<p>Does the recycling center have sufficient capacity to handle projected incoming volumes of yard trimmings? \u00a0[N.J.A.C. 7:26A-4.5(a)2]<\/p>\n<p>Does facility only receive yard trimmings during times when the recycling center operator or owner is present? \u00a0[N.J.A.C. 7:26A-4.5(a)4]<\/p>\n<p>Were all yard trimmings removed from bags and boxes and were these containers placed in a suitable refuse receptacle in the staging area of the recycling center for removal to an off-site disposal facility in accordance with N.J.A.C. 7:26-6?\u00a0 Note: Yard trimmings in paper or biodegradable plastic bags need not be removed from such bags if the processing equipment provides for a shredding or cutting action. [N.J.A.C. 7:26A-4.5(a)5]<\/p>\n<p>Within one year of the start up of the recycling center, did the recycling center operator attend a composting course sponsored by the Rutgers Cooperative Extension, the appropriate county agricultural or resource management agents or any other similar course recognized by the Department? \u00a0[N.J.A.C. 7:26A-4.5(a)7i]<\/p>\n<p>Is the active composting surface an improved surface, such as compacted clay, gap-graded crushed aggregate, asphalt or other such surface that can withstand heavy equipment use and is the surface sloped to prevent ponding of liquids and to prevent surface runoff from directly entering any surface waters? \u00a0[N.J.A.C. 7:26A-4.5(a)7ii]<\/p>\n<p>Prior to windrow formation, are dry yard trimmings moistened to saturation without producing excessive runoff? \u00a0[N.J.A.C. 7:26A-4.5(a)7iii]<\/p>\n<p>To facilitate drainage and to reduce surface water ponding, was each windrow constructed and positioned in such a manner that it is perpendicular to the contours of the ground surface? \u00a0[N.J.A.C. 7:26A-4.5(a)7iv]<\/p>\n<p>Is a windsock installed at the recycling center in order to indicate wind direction so that the recycling center operator may determine appropriate times for windrow turning operations? \u00a0[N.J.A.C. 7:26A-4.5(a)7v]<\/p>\n<p>Does the recycling center employ one of the allowed methods of windrow composting? \u00a0[N.J.A.C. 7:26A-4.5(a)7vi]<\/p>\n<p>Did the recycling center submit to the Department within one year of receipt of its general approval to operate, a final closure plan containing a schedule and description of the steps necessary to close the recycling center including the estimated cost of closure and a description of the means by which the closure will be financed? \u00a0[N.J.A.C. 7:26A-4.5(a)8]<\/p>\n<p><strong>REQUIREMENTS FOR CLASS C RECYCLING CENTERS WHICH ENGAGE IN COMPOSTING OPERATIONS<\/strong><\/p>\n<p><strong>ADDITIONAL OPERATIONAL REQUIREMENTS FOR CLASS C RECYCLING CENTERS RECEIVING MATERIALS OTHER THAN OR IN ADDITION TO YARD TRIMMINGS<\/strong><\/p>\n<p>Is the recycling center equipment operated in conformance with the manufacturer and\/or vendor specifications or appropriately documented modifications?\u00a0 Note: Such equipment specifications, including modifications, shall be included in the operations and maintenance manual. [N.J.A.C. 7:26A-4.5(b)6]<\/p>\n<p>Are all employees properly trained in the recycling center operations, maintenance procedures, and safety and emergency procedures? \u00a0[N.J.A.C. 7:26A-4.5(b)7]<\/p>\n<p>Was a recycling center-specific training manual developed and made available to each employee. [N.J.A.C. 7:26A-4.5(b)8]<\/p>\n<p>Does the operator begin processing of incoming material within three days of receipt, and process grass and other highly putrescible materials on the working day of receipt of such material? \u00a0[N.J.A.C. 7:26A-4.5(b)11]<\/p>\n<p>Is the facility using a laboratory to perform the analysis of the finished compost product which is certified in accordance with N.J.A.C. 7:18 for the equipment and testing procedures required pursuant to N.J.A.C. 7:26A-4.5(b)20. [N.J.A.C. 7:26A-4.5(b)21]<\/p>\n<p>Is the facility complying with all requirements necessary for compost given away or offered for sale, specifically: 1. Compost given away or offered for sale by the recycling center must contain a label describing the recommended safe uses and application rates, and restrictions, if any, on use of the product. If compost is offered for bulk sale, signs or printed literature containing the above information shall be available on the bill of lading to the purchaser or persons receiving the compost. 2. Compost given away or offered for sale shall satisfy the following requirements:\u00a0 i. Compost derived from yard trimming shall satisfy the requirements established at 40 C.F.R. 503.13(b)3; and ii. Compost derived from other than or in addition to yard trimmings shall satisfy the requirements established at 40 C.F.R. 503.13(b)3, the Class A pathogen requirements at 40 C.F.R. 503.32(a), and one of the vector attraction reduction requirements in 40 C.F.R. 503.33(b)1 through 8. [N.J.A.C. 7:26A-4.5(c)]<\/p>\n<p>The Department shall formulate comprehensive policies for the conservation of the natural resources of the State, the promotion of environmental protection and the prevention of pollution of the environment of the State. The department shall in addition to the powers and duties vested in it by this act or by any other law have the power to: Enter and inspect any building or place for the purpose of investigating an actual or suspected source of pollution of the environment and ascertaining compliance or noncompliance with any codes, rules and regulations of the department. Any information relating to secret processes concerning methods of manufacture or production, obtained in the course of such inspection, investigation or determination, shall be kept confidential, except this information shall be available to the department for use, when relevant, in any administrative or judicial proceedings undertaken to administer, implement, and enforce State environmental law, but shall remain subject only to those confidentiality protections otherwise afforded by federal law and by the specific State environmental laws and regulations that the department is administering, implementing and enforcing in that particular case or instance. In addition, this information shall be available upon request to the United States Government for use in administering, implementing, and enforcing federal environmental law, but shall remain subject to the confidentiality protection afforded by federal law. If samples are taken for analysis, a duplicate of the analytical report shall be furnished promptly to the person suspected of causing pollution of the environment.
