{"id":276,"date":"2024-08-06T13:16:13","date_gmt":"2024-08-06T17:16:13","guid":{"rendered":"https:\/\/deptest.nj.gov\/wastecompliance\/?page_id=276"},"modified":"2025-10-29T16:11:37","modified_gmt":"2025-10-29T20:11:37","slug":"hazardous-waste-small-quantity-generators","status":"publish","type":"page","link":"https:\/\/deptest.nj.gov\/wastecompliance\/hazardous-waste\/hazardous-waste-small-quantity-generators\/","title":{"rendered":"Hazardous Waste: Small Quantity Generators"},"content":{"rendered":"<p>[vc_row][vc_column][vc_column_text css=&#8221;&#8221;]<strong>Quantity Limits:<\/strong><\/p>\n<ul>\n<li>Generate between 2,640\u202f and 26,400 pounds of hazardous waste per month <strong>and <\/strong>less than 2 pounds of acutely hazardous waste per month.<\/li>\n<li>Quantity of hazardous on-site waste must never exceed 13,200 pounds.<\/li>\n<\/ul>\n<ul>\n<li>May accumulate hazardous waste on-site for 180 days without a permit (or 270 days if shipping a distance greater than 200 miles).<\/li>\n<\/ul>\n<p><strong>Requirements:<\/strong><\/p>\n<ul>\n<li>Must identify all the hazardous waste generated.<\/li>\n<li>Must ensure that hazardous waste is delivered to a person or facility who is authorized to manage it.<\/li>\n<li>Must obtain a <a href=\"https:\/\/rcrainfo.epa.gov\/rcrainfoprod\/action\/secured\/login\" target=\"_blank\" rel=\"noopener\">USEPA identification number<\/a> using myRCRAid service<\/li>\n<li>Must comply with the <a href=\"https:\/\/www.epa.gov\/hwgenerators\/hazardous-waste-manifest-system\" target=\"_blank\" rel=\"noopener\">hazardous waste manifest requirements<\/a> at 40 CFR part 262, subpart B and the pre-transport requirements at 40 CFR sections 262.30 through 262.33.<\/li>\n<li>Must <a href=\"https:\/\/www.nj.gov\/dep\/enforcement\/advisories\/2020-19.pdf\">renotify<\/a> by September 1, 2021 and every four years thereafter using myRCRAid service of <a href=\"https:\/\/rcrainfo.epa.gov\/rcrainfoprod\/action\/secured\/login\">RCRAinfo<\/a><\/li>\n<li>Must manage <a href=\"https:\/\/www.epa.gov\/hwpermitting\/hazardous-waste-management-facilities-and-units\" target=\"_blank\" rel=\"noopener\">hazardous waste in tanks or containers<\/a> subject to the requirements found at 40 CFR sections 262.16(b)(2) and (3).<\/li>\n<li>Must comply with the preparedness and prevention requirements at 40 CFR sections 262.16(b)(8) and (9), and the <a href=\"https:\/\/www.epa.gov\/hw\/land-disposal-restrictions-hazardous-waste\" target=\"_blank\" rel=\"noopener\">land disposal restriction requirements<\/a> at 40 CFR part 268.<\/li>\n<li>Must always be at least one employee available to respond to an emergency. This employee is the emergency coordinator responsible for coordinating all emergency response measures. By this adoption, the Department \u201cincorporated by reference\u201d (with limited exception) the July 1, 1993 version of the Federal hazardous waste regulations at 40 CFR Parts 124, 260-266, 268 and 270, mandated by the Resource Conservation and Recovery Act of 1976 (RCRA) and amended by the 1984 Hazardous and Solid Waste Amendments (HSWA).
