(N.J.A.C. 7:14A), unless otherwise stated or unless the context clearly requires a different meaning.<\/p>\n<p><strong><u>Act<\/u><\/strong>\u2013 means the\u00a0<a href=\"https:\/\/www.njleg.state.nj.us\/2018\/Bills\/PL19\/42_.PDF\" target=\"_blank\" rel=\"noopener\">\u201cClean Stormwater and Flood Reduction Act\u201d\u00a0<i class=\"fas fa-file-pdf text-danger\" title=\"Adobe Acrobat PDF file\"><\/i><\/a>which is the act that allows for the formation of stormwater utilities in New Jersey.<\/p>\n<p><strong><u>BRE<\/u><\/strong>\u00a0\u2013 Business Risk Exposure, which is a method of calculating (scoring) the nature and level of exposure that a utility is likely to confront through a potential failure of a specified asset<\/p>\n<p><strong><u>BMP<\/u><\/strong>\u2013 Best Management Practices, or measures that are designed to achieve the permittee\u2019s requirement to reduce the discharge of pollutants from the permittee\u2019s property, i.e. the municipality\u2019s MS4, municipal maintenance yards and other ancillary operations, to protect water quality, and to satisfy the applicable water quality requirements of the Clean Water Act.<\/p>\n<p><strong><u>BMP Manual<\/u><\/strong>\u2013 the New Jersey Stormwater Best Management Practice Manual. This manual provides guidance to address the standards in the Stormwater Management Rules at N.J.A.C. 7:8. A link to this manual can be found at\u00a0<a href=\"https:\/\/deptest.nj.gov\/stormwater\/bmp-manual\/\" rel=\"noopener\">https:\/\/deptest.nj.gov\/stormwater\/bmp-manual\/<\/a><\/p>\n<p><strong><u>CSO<\/u><\/strong>\u00a0\u2013 &#8220;Combined Sewer Overflow&#8221;, or the excess flow from the combined sewer system which is not conveyed to the domestic treatment works for treatment, but transmitted by pipe or other channel directly to waters of the State. \u00a0For more information on the CSOs in New Jersey, please see \u2013\u00a0<a href=\"https:\/\/deptest.nj.gov\/dwq\/combined-sewer-overflow\/\">https:\/\/deptest.nj.gov\/dwq\/combined-sewer-overflow\/<\/a><\/p>\n<p><strong><u>CWA<\/u><\/strong>\u00a0\u2013 the Clean Water Act also known as the Federal Act or Federal Clean Water Act (33 U.S.C. et seq.) including all subsequent supplements and amendments.\u2013\u00a0<a class=\"listblue\" href=\"https:\/\/www.epa.gov\/laws-regulations\/summary-clean-water-act\" target=\"_blank\" rel=\"noopener\">Clean Water Act\u00a0<\/a><\/p>\n<p><u><strong>DCA\u00a0<\/strong><\/u>\u2013 the New Jersey Department of Community Affairs \u2013\u00a0<a href=\"https:\/\/www.nj.gov\/dca\/\">https:\/\/www.nj.gov\/dca\/<\/a><\/p>\n<p><strong><u>EPA<\/u>\u00a0<\/strong>\u2013 the United States Environmental Protection Agency \u2013\u00a0<a href=\"https:\/\/www.epa.gov\/\" target=\"_blank\" rel=\"noopener\">https:\/\/www.epa.gov\/<\/a><\/p>\n<p><u><strong>GI<\/strong><\/u>\u00a0\u2013 Green Infrastructure, which is a stormwater management measure that manages stormwater close to its source by treating stormwater runoff through infiltration into subsoil, treating stormwater runoff through filtration by vegetation or soil, or storing stormwater runoff for reuse.<\/p>\n<p>This is the definition from the Stormwater Management Rules at N.J.A.C. 7:8.\u00a0 Please see this link <a href=\"https:\/\/deptest.nj.gov\/stormwater\/stormwater-management\/stormwater-management-rule-n-j-a-c-78\/\">here\u00a0<\/a>. To accomplish this, permits are issued limiting the mass and\/or concentration of pollutants which may be discharged into groundwater, streams, rivers, and the ocean. According to the Western Kentucky University Stormwater Utility Survey (<a href=\"https:\/\/digitalcommons.wku.edu\/seas_faculty_pubs\/22\/\" target=\"_blank\" rel=\"noopener\">versions<\/a>), two of the first stormwater utilities in the country were formed in 1974 in Boulder, Colorado and Bellevue, Washington. As of 2019 when the Act was passed, there were 1,716 stormwater utilities that had formed nationwide in 40 states plus Washington D.C. and Canada.
