Notice of Rule Proposal <\/strong>and State Implementation Plan Revision<\/strong> PUBLIC NOTICE<\/strong> This proposed rulemaking\u00a0is part of a comprehensive strategy to\u00a0reduce greenhouse gas emissions\u00a0statewide.\u00a0Proposed N.J.A.C. 7:27F represents a new chapter of the Department\u2019s administrative rules with three major components that are intended to focus on reductions of carbon dioxide (CO2) from stationary sources.\u00a0 Through this rulemaking, the Department proposes to reduce CO2 emissions from: (1) fossil fuel-fired electric generating units (EGUs) through the application of output-based emission limits, (2) certain commercial and industrial fossil fuel-fired boilers based upon an additional permit requirement, and (3) No. 4 and No. 6 fuel oil by banning its sale and use.\u00a0 The new rules will have the additional benefit of reducing air pollutants such as oxides of nitrogen, sulfur dioxide, direct particulate matter, and hazardous air pollutants.\u00a0 In addition to the new permit requirement for certain boilers, the Department is proposing a boiler fleet reporting requirement, which may inform future rulemaking.\u00a0 Finally, the proposed rulemaking includes penalty provisions in N.J.A.C. 7:27A.<\/p>\n The proposal is scheduled to be published in the New Jersey Register dated December 6, 2021.\u00a0 A copy of the proposal is available on the Department\u2019s webpages at: https:\/\/deptest.nj.gov\/rules\/wp-content\/uploads\/sites\/70\/proposals\/20211206a.pdf<\/a> and https:\/\/www.state.nj.us\/dep\/aqm\/curformp.html<\/a>, and LexisNexis free public access to the New Jersey Register (https:\/\/www.lexisnexis.com\/hottopics\/njoal<\/a>).<\/p>\n A public hearing concerning the proposal will be conducted virtually via the Department\u2019s video conferencing software on February 1, 2022, at 9:00 A.M.<\/p>\n Please join the meeting from your computer, tablet, or smartphone<\/strong>. \u00a0<\/strong>You can also dial in using your phone<\/strong>.
