\n<\/b>Take notice that the NJ Department of Environmental Protection
\nis proposing new rules, amendments, and recodification. A statement
\nof the substance of the proposal follows:<\/p>\n
The proposed new rules, amendments, and recodification in N.J.A.C.
\n7:14A will revise requirements concerning stormwater discharge
\npermits, address new “Phase II” regulations that the
\nUnited States Environmental Protection Agency published in the
\nDecember 8, 1999 Federal Register concerning such permits, and
\nintegrate the New Jersey Pollutant Discharge Elimination System
\n(NJPDES) program for “municipal” (that is, government
\nagency) separate storm sewer systems with other aspects of stormwater
\nmanagement. In addition, proposed amendments will address the
\n1999 changes to the Federal Underground Injection Control (UIC)
\nregulations and revise other UIC requirements relating to the
\nissuance of the permits.<\/p>\n
Most of the proposal focuses on the establishment and implementation
\nof the proposed Municipal Stormwater Regulation Program. Under
\nthis Program, potentially all of New Jersey’s 566 municipalities,
\nall 21 counties, the New Jersey Department of Transportation (NJDOT),
\nState highway authorities, and many other State, interstate, and
\nFederal agencies will be required to obtain a NJPDES permit for
\ntheir stormwater discharges. The proposal also expands NJPDES
\npermit requirements for stormwater discharges associated with
\nconstruction activity, excludes from the NJPDES permit requirement
\nstormwater discharges from industrial facilities that have “Permanent
\nNo Exposure” of industrial activities or materials to stormwater,
\nextends the deadline by which certain publicly owned or operated
\nindustrial facilities must apply for a NJPDES stormwater permit,
\nand eliminates the August 7, 2001 deadline by which other “Phase
\nII” sources must apply for a NJPDES stormwater permit.<\/p>\n
The proposal is scheduled to be published in the New Jersey Register
\ndated January 6, 2003.<\/p>\n
