The existing rules govern<br \/>\nloans to public owned community water supply systems for the<br \/>\nrehabilitation or repair of antiquated, obsolete, damaged or<br \/>\ninadequately operating water facilities; for the interconnection<br \/>\nof unconnected or inadequately connected water systems; for<br \/>\nthe rehabilitation, repair, or construction of new drinking<br \/>\nwater treatment facilities; for the construction of water supply<br \/>\nfacilities or public water systems to address groundwater contamination<br \/>\nproblems.\u00a0 In the instance of contaminated wellfields,<br \/>\nprivately owned community water supply systems are eligible<br \/>\nto apply for a replacement loan.<\/p>\n<p>The immediate task is to readopt the current rules without<br \/>\nchange to allow the Department to continue to process current<br \/>\nwater supply loan applications, in anticipation of the rule<br \/>\nsunset date which is on May 10, 2007. \u00a0No new applications<br \/>\nhave been accepted under the Water Supply Loan Programs since<br \/>\n1997.\u00a0 The Department previously committed to the existing<br \/>\nproject sponsors to process and to complete all remaining applications<br \/>\nfor projects that were received on or prior to June 30, 1997.<\/p>\n<p>It is anticipated that the unit within the Department responsible<br \/>\nfor this program will close-out the Water Supply Loan Programs<br \/>\nabout December 2007.\u00a0 The rules need to remain in effect<br \/>\nuntil all the loans are repaid to the State, since the loan<br \/>\nagreement documents specifically reference the rules.<\/p>\n<p>The proposal is scheduled to be published in the New Jersey<br \/>\nRegister dated June 18, 2007. <a href=\"https:\/\/deptest.nj.gov\/rules\/wp-content\/uploads\/sites\/70\/proposals\/061807a.pdf\">A<br \/>\ncopy of the proposal is available from the DEP web site<\/a> or by contacting the rule manager, Roger<br \/>\nTsao, Bureau of Loans and Data Management at (609) 292-5550.<\/p>\n<p>Written comments may be submitted by August 17, 2007 to:<\/p>\n<blockquote><p>NJ<br \/>\nDepartment of Environmental Protection<br \/>\nOneida<br \/>\nCuevas, Esquire<br \/>\nATTN:<br \/>\nDEP Docket No. 12-07-05\/625<br \/>\nOffice<br \/>\nof Legal Affairs<br \/>\nPO<br \/>\nBox 402<br \/>\nTrenton,<br \/>\nNew Jersey 08625<\/p><\/blockquote>\n","protected":false},"excerpt":{"rendered":"<p>NJ DEPARTMENT of ENVIRONMENTAL PROTECTION Assistant Commissioner Mark Mauriello Land Use Management Notice of Rule Proposal Water Supply Loan Programs, N.J.A.C 7:1A Public Notice Take notice that the NJ Department of Environmental Protection is proposing the readoption of the rules without change for the Water Supply Loan Programs rules.
