New Jersey<br \/>\nproposes to repeal its obsolete National Low Emission Vehicle<br \/>\n(NLEV) Program rules (N.J.A.C. 7:27-26) and related provisions<br \/>\nin the Heavy-Duty Diesel New Engine Requirements Program rules<br \/>\n(N.J.A.C. 7:27-28). This proposal affects only the NLEV program<br \/>\nportion of the rules. Amendments to the Heavy-Duty Diesel New<br \/>\nEngine Program Requirements were proposed separately (see 33<br \/>\nN.J.R. 2381, December 20, 2004). In addition, as directed by<br \/>\nN.J.S.A. 26:2C-8.15, et seq., the Department is proposing a<br \/>\nnew subchapter 29 to implement the California Low Emission Vehicle<br \/>\n(LEV) program in New Jersey, and add related penalties at N.J.A.C.<br \/>\n7:27A-3.10, Air Administrative Procedures and Penalties. This<br \/>\naction is consistent with N.J.S.A. 26:2C-8.15 et seq., which<br \/>\nrequires the Department to promulgate rules adopting the current<br \/>\nCalifornia LEV program, and the Federal Clean Air Act, section<br \/>\n177 (42 U.S.C. \u00a7 7507), which grants the authority to other<br \/>\nstates to establish more stringent standards than the Federal<br \/>\nprogram by implementing the California program. This proposal<br \/>\nalso constitutes a proposed revision to New Jersey&#8217;s State Implementation<br \/>\nPlan (SIP) for attainment of national ambient air quality standards.<\/p>\n<p>The proposal is scheduled to be published in the New Jersey<br \/>\nRegister dated August 1, 2005. <a href=\"https:\/\/deptest.nj.gov\/rules\/wp-content\/uploads\/sites\/70\/proposals\/080105b.pdf\" target=\"_blank\" rel=\"noopener\">A<br \/>\ncopy of the proposal is available from the Department\u2019s<br \/>\nweb site<\/a> <span class=\"specialNote\">(PDF)<\/span>, the Department\u2019s<br \/>\nPublic Information Center at 401 E.
