\nTake notice that the New Jersey Department of Environmental
\nProtection (Department) is proposing new rules and amendments
\nof its rules at N.J.A.C. 7:27-24 and N.J.A.C. 7:27A-3.10, its
\nrules relating to the prevention of air pollution from consumer
\nproducts. The proposal also constitutes a proposed revision
\nto the State\u2019s Ozone State Implementation Plan (SIP),
\nand a copy was forwarded to the United States Environmental
\nProtection Agency (EPA). A statement of the substance of the
\nproposal follows:<\/p>\n
The Department has initiated efforts to adopt new rules and
\namendments to incorporate six regional air pollution control
\nmodel rules endorsed by the Ozone Transport Commission (OTC).
\nThese six model rules were previously identified in the State\u2019s
\nOzone SIP to meet a USEPA identified emission reduction shortfall.
\nThis proposed rule for consumer products includes two of these
\nsix model rules \u2013 the OTC model rule for consumer products
\nand the OTC model rule for portable fuel containers. The goals
\nof this rulemaking are: to reduce volatile organic compound
\n(VOC) emissions to assist in the attainment of the one-hour
\nozone health standard; to demonstrate to the USEPA that New
\nJersey is meeting its obligation for the VOC emission shortfall;
\nand to adopt a regionally consistent rule.<\/p>\n
These proposed rules would apply to consumer products whose
\nuse may result in the release to the atmosphere of VOCs. These
\nconsumer products are of two types. The first type is chemically
\nformulated products, such as hair spray, insecticides, and cleaners,
\nwhich include VOCs in their formulation and which release VOCs
\ninto the atmosphere when they are used. The proposed rules control
\nemissions by establishing limits on the VOC content of these
\nproducts. The second type is portable fuel containers, from
\nwhich VOC vapors may be emitted when fuel is poured into or
\nout of the containers, or when fuel is stored in the containers.
\nThe proposed rules control emissions by establishing design
\nstandards for portable fuel containers and their spouts.<\/p>\n
The proposal is scheduled to be published in the New Jersey
\nRegister dated September 15, 2003. Copies of the Department\u2019s
