{"id":1585,"date":"2021-12-02T13:38:21","date_gmt":"2021-12-02T18:38:21","guid":{"rendered":"https:\/\/deptest.nj.gov\/rules\/?page_id=1585"},"modified":"2021-12-02T13:38:21","modified_gmt":"2021-12-02T18:38:21","slug":"092004b","status":"publish","type":"page","link":"https:\/\/deptest.nj.gov\/rules\/notice-of-rule-proposal-archive\/092004b\/","title":{"rendered":"092004b"},"content":{"rendered":"<p><b>NJ DEPARTMENT of ENVIRONMENTAL PROTECTION<br \/>\n<\/b>ENVIRONMENTAL REGULATION<br \/>\nDIVISION OF AIR QUALITY<br \/>\nAIR QUALITY PERMITTING ELEMENT<\/p>\n<p><strong>Notice of Rule Proposal<\/strong><br \/>\nN.J.A.C. 7:27-19 Control and Prohibition of Air Pollution from Oxides of Nitrogen (NOx) and other related provisions at N.J.A.C. 7:27-8.1, 8.2; 7:27-16.1, 16.8, 16.9, 16.10, 16.16; 7:27-22.1; 7:27A-3.10<\/p>\n<p><b>Public Notice<\/b><\/p>\n<p>Take notice that the New Jersey Department of Environmental<br \/>\nProtection (Department) is proposing new rules and amendments<br \/>\nat N.J.A.C. 7:27-19, Control and Prohibition of Air Pollution<br \/>\nfrom Oxides of Nitrogen (NO x). The Department is also proposing<br \/>\nrelated amendments to N.J.A.C. 7:27-8, Permits and Certificates for Minor Facilities<br \/>\nand Major Facilities Without an Operating Permit; N.J.A.C. 7:27-16, Control<br \/>\nand Prohibition of Air Pollution by Volatile Organic Compounds; N.J.A.C. 7:27-22,<br \/>\nOperating Permits (for Major Facilities); and N.J.A.C. 7:27A-3.10, Air Administrative<br \/>\nProcedures and Penalties. This proposal also constitutes a proposed revision<br \/>\nto the State\u2019s Ozone State Implementation Plan (SIP) and a copy was forwarded<br \/>\nto the United States Environmental Protection Agency (USEPA). A statement of<br \/>\nthe substance of the proposal follows:<\/p>\n<p>The Department has initiated efforts to adopt new rules and<br \/>\namendments to incorporate six regional air pollution control<br \/>\nmeasures endorsed by the Ozone Transport Commission (OTC).<br \/>\nThese six measures were previously identified in the State\u2019s<br \/>\nOzone SIP to meet a USEPA identified ozone precursor emission<br \/>\nreduction shortfall. This proposed rule for additional NO x<br \/>\ncontrol measures is the last one of the six measures. The goals<br \/>\nof this rulemaking are: to obtain additional reductions of<br \/>\nNO x emissions to assist in the attainment of the National<br \/>\nAmbient Air Quality Standard (NAAQS); to address the NO x emission<br \/>\nreduction shortfall identified by the USEPA; and to implement<br \/>\nthe Department&#8217;s Ozone SIP commitment to USEPA.<\/p>\n<p>These new rules and amendments would apply to owners or operators<br \/>\nof stationary sources of NO x emissions, including industrial\/commercial\/institutional<br \/>\nboilers, combustion turbines, and reciprocating engines. Owners<br \/>\nor operators of such sources would be required to achieve the<br \/>\nemission rate limit specified in the rules or to comply instead<br \/>\nwith alternatives if technically or economically infeasible.<br \/>\nThese rules would also regulate emissions from distributed<br \/>\ngeneration, consistent with the OTC recommendation in its March<br \/>\n2001 &#8220;Resolution of the States of the Ozone Transport<br \/>\nCommission Concerning the Creation of Incentives for Additional<br \/>\nClean Distributed Generation of Electric Power.&#8221; Distributed<br \/>\ngeneration is the use of small scale electric generating technologies<br \/>\ninstalled at, or in close proximity to, the end user&#8217;s location.<br \/>\nThe proposed new rules and amendments would seek better control<br \/>\non diesel electric generators and encourage the use of cleaner<br \/>\ntechnologies, such as fuel cells and microturbines.<\/p>\n<p>The proposal is scheduled to be published in the New Jersey<br \/>\nRegister dated September 20, 2004.
