{"id":1575,"date":"2021-12-02T13:24:49","date_gmt":"2021-12-02T18:24:49","guid":{"rendered":"https:\/\/deptest.nj.gov\/rules\/?page_id=1575"},"modified":"2021-12-02T13:24:49","modified_gmt":"2021-12-02T18:24:49","slug":"100206a","status":"publish","type":"page","link":"https:\/\/deptest.nj.gov\/rules\/notice-of-rule-proposal-archive\/100206a\/","title":{"rendered":"100206a"},"content":{"rendered":"<p><b>NJ DEPARTMENT of ENVIRONMENTAL PROTECTION<br \/>\n<\/b>LAND USE MANAGEMENT<br \/>\nDIVISION<br \/>\nOF LAND USE REGULATION<\/p>\n<p><strong>Notice of Rule Proposal<\/strong><br \/>\nProposed Repeal and New Rules:<br \/>\nFlood Hazard Area Control Rules, N.J.A.C. 7:13<\/p>\n<p>Proposed Amendments and New Rules:<br \/>\nNinety-Day Construction Permits Rules, N.J.A.C. 7:1C<br \/>\nCoastal Permit Program Rules, N.J.A.C. 7:7<br \/>\nCoastal Zone Management Rules, N.J.A.C. 7:7E<\/p>\n<p><b>Public Notice<\/b><br \/>\nTake notice that the New Jersey Department of Environmental Protection (Department)<br \/>\nis proposing to repeal the existing Flood Hazard Area Control<br \/>\nrules and to adopt new rules in its place. The Department<br \/>\nis also proposing related amendments to the Ninety-Day Construction<br \/>\nPermits rules, Coastal Permit Program rules and Coastal Zone<br \/>\nManagement rules. A statement of the substance of the proposal<br \/>\nfollows:<\/p>\n<p>The Flood Hazard Area Control rules implement the New Jersey<br \/>\nFlood Hazard Area Control Act, N.J.S.A. 58:16A-50 et seq.,<br \/>\nthrough which the Department executes the directive to &#8220;adopt<br \/>\nland use regulations for the flood hazard area, to control<br \/>\nstream encroachments, to coordinate effectively the development,<br \/>\ndissemination, and use of information on floods and flood<br \/>\ndamages that may be available.&#8221; The<br \/>\nDepartment&#8217;s experience in administering these rules,<br \/>\nas well as the recent flood events in the State, have demonstrated<br \/>\nthe need to adopt new rules that will better protect the<br \/>\npublic from the hazards of flooding, preserve the quality<br \/>\nof surface waters and protect the wildlife and vegetation<br \/>\nthat exist within and depend upon such areas for sustenance<br \/>\nand habitat.<\/p>\n<p>Unless properly controlled, development within flood hazard areas<br \/>\ncan increase the intensity and frequency of flooding by reducing<br \/>\nflood storage, increasing stormwater runoff and obstructing<br \/>\nthe movement of floodwaters. In addition, structures that<br \/>\nare improperly built in flood hazard areas are subject to<br \/>\nflood damage and threaten the health, safety and welfare<br \/>\nof those who use them. Furthermore, healthy vegetation adjacent<br \/>\nto surface waters is essential for maintaining bank stability<br \/>\nand water quality. The indiscriminate disturbance of such<br \/>\nvegetation can destabilize channels, leading to increased<br \/>\nerosion and sedimentation that exacerbates the intensity<br \/>\nand frequency of flooding. The loss of vegetation adjacent<br \/>\nto surface waters also reduces filtration of stormwater runoff<br \/>\nand thus degrades the quality of these waters.<\/p>\n<p>In light of the concerns described above, the proposed new Flood<br \/>\nHazard Area Control rules incorporate<br \/>\nmore stringent standards for development in flood hazard<br \/>\nareas and adjacent to surface waters in order to mitigate<br \/>\nthe adverse impacts to flooding and the environment that<br \/>\ncan be caused by development. Consequently, a large number<br \/>\nof significant changes are being proposed to the construction<br \/>\nand environmental standards of the rules. For example, under<br \/>\nthe proposed rules, any flood storage that is lost due to<br \/>\nmost new construction activities must be compensated by the<br \/>\ncreation of an equal volume of flood storage either onsite<br \/>\nor in close proximity to the development. This will preserve<br \/>\nexisting flood storage and help mitigate increases in flooding<br \/>\nover time. Furthermore, the 25-ft and 50-ft stream buffers<br \/>\nunder the existing rules are proposed for expansion to 50-ft,<br \/>\n150-ft and 300-ft, depending on the environmental resources<br \/>\nof each stream. Many other changes are also being proposed<br \/>\nto protect the public from the hazards of flooding, prevent<br \/>\nunnecessary impacts to stream corridors, and facilitate projects<br \/>\nthat would benefit the environment and not contribute to<br \/>\nflooding.<\/p>\n<p>The Department is also proposing related amendments to the Coastal<br \/>\nPermit Program rules, N.J.A.C. 7:7, and to the Coastal Zone<br \/>\nManagement rules, N.J.A.C. 7:7E, in order to ensure better<br \/>\nconsistency with N.J.A.C. 7:13 as regards development in<br \/>\nflood hazard areas and preservation of vegetation and habitat<br \/>\nalong surface waters. For example, the new construction and<br \/>\nenvironmental standards of the Flood Hazard Area Control<br \/>\nrules are proposed for incorporation into the coastal rules,<br \/>\nand the proposed stream buffers described above would be<br \/>\nextended to include most tidal waterways. In addition, flood<br \/>\nhazard area application fees and review procedures are proposed<br \/>\nto be relocated into the Flood Hazard Area Control rules<br \/>\nfrom the Ninety-Day Construction Permits rules, N.J.A.C.<br \/>\n7:1C, so that all fees and application review standards are<br \/>\nlocated in one rule.<\/p>\n<p>The proposal is scheduled to be published in the New Jersey Register<br \/>\ndated October 2, 2006.
