{"id":1571,"date":"2021-12-02T13:12:40","date_gmt":"2021-12-02T18:12:40","guid":{"rendered":"https:\/\/deptest.nj.gov\/rules\/?page_id=1571"},"modified":"2026-02-24T13:56:22","modified_gmt":"2026-02-24T18:56:22","slug":"100410a","status":"publish","type":"page","link":"https:\/\/deptest.nj.gov\/rules\/notice-of-rule-proposal-archive\/100410a\/","title":{"rendered":"100410a"},"content":{"rendered":"<p>[vc_row][vc_column][vc_column_text css=&#8221;&#8221;]<b>NJ DEPARTMENT of ENVIRONMENTAL PROTECTION<\/b><br \/>\nSite Remediation Program<\/p>\n<p><strong>Notice of Rule Proposal<br \/>\n<\/strong>Administrative Requirements for the Remediation of Contaminated Sites Rules, N.J.A.C. 7:26C and Technical Requirements for the Remediation of Contaminated Sites Rules, N.J.A.C. 7:26E<\/p>\n<p><b>Public Notice<\/b><br \/>\nTake notice that the NJ Department of Environmental Protection is proposing amendments to the Administrative Requirements for the Remediation of Contaminated Sites (ARRCS) rules, N.J.A.C. 7:26C and the Technical Requirements for the Remediation of Contaminated Sites (Technical Requirements) rules, N.J.A.C. 7:26E.<\/p>\n<p>On November 4, 2009, the Department adopted interim rules to implement the Site Remediation Reform Act (SRRA), N.J.S.A. 58:10C-1 et seq.\u00a0 The interim rules include the new ARRCS rules and amendments to the Technical Requirements.\u00a0 The ARRCS rules establish mandatory timeframes and the Technical Requirements establish regulatory timeframes for certain aspects of remediation.<\/p>\n<p>Since the adoption of the interim rules, the Department has conducted stakeholder outreach.\u00a0 Stakeholders expressed concern that the mandatory and regulatory timeframes are too short.<\/p>\n<p>Therefore, the Department is proposing to amend the mandatory remediation timeframes established in the ARRCS rules by extending them for one additional year, and is also proposing to amend the regulatory timeframes set forth in the Technical Requirements in order to afford the person responsible for conducting the remediation a full one year \u201csafety cushion\u201d to ensure that the mandatory timeframes are met.<\/p>\n<p>Stakeholders were also concerned that the definition of an immediate environmental concern involving indoor air in the Technical Requirements is too conservative and not consistent with the definition of immediate environmental concern in SRRA. The Department is proposing to amend the trigger for an immediate environmental concern in indoor air in the Technical Requirements from an exceedance of the\u00a0 screening level to the exceedance of the rapid action level contained in or developed consistent with the Department\u2019s Vapor Intrusion Guidance<\/p>\n<p>The proposal is scheduled to be published in the New Jersey Register dated October 4, 2010.\u00a0 A <a href=\"https:\/\/deptest.nj.gov\/rules\/wp-content\/uploads\/sites\/70\/proposals\/100410a.pdf\" target=\"_blank\" rel=\"noopener\">copy of the proposal<\/a> is available from the Department\u2019s website, or may be purchased from Lexis\/Nexis at <a href=\"https:\/\/www.lexisnexis.com\/hottopics\/njoal\/\" target=\"_blank\" rel=\"noopener\">https:\/\/www.lexisnexis.com\/hottopics\/njoal\/<\/a><em>. <\/em><\/p>\n<p>Two public hearings concerning the proposal are scheduled as follows:<\/p>\n<blockquote><p>Monday, November 1, 2010 from 10 a.m. to 12 p.m.<br \/>\nNew Jersey Department of Environmental Protection<br \/>\nPublic Hearing Room<br \/>\n401 E.
