\n<\/strong>Dam Safety Standards,\u00a0 N.J.A.C. 7:20<\/p>\n
\nTake notice that the New Jersey Department of Environmental Protection has proposed the readoption of the Dam Safety Standards, N.J.A.C. 7:20 without amendment.\u00a0 The Department has reviewed these rules and has determined them to be necessary, reasonable and proper for the purpose for which they were originally promulgated. N.J.A.C. 7:20 implements the Safe Dam Act, N.J.S.A. 58:4-1 et seq. and governs the design, construction, inspection, operation, maintenance, modifications and repair of dams in New Jersey which raise the water height of a stream by more than five feet.\u00a0 Certain dams in the pinelands area are exempt from these rules so long as they do not pose a security or safety concern (see N.J.S.A. 58:4-1).\u00a0 The primary objective of these rules is to ensure the protection of areas below dams from the consequences of their failure.\u00a0 Dams and their appurtenant structures are required to be inspected and maintained on a regular basis in order to determine if repairs or modifications are necessary to protect life and property.<\/p>\n
