NOTICE OF SUBSTANTIAL CHANGES ON ADOPTION<\/strong> PUBLIC NOTICE<\/strong>
\nNOISE CONTROL, N.J.A.C. 7:29<\/p>\n
\nTake notice<\/strong> that the Department in accordance with the Administrative Procedure Act, N.J.S.A. 52:14C-4.10, is proposing substantial changes to the Noise Control rules at N.J.A.C. 7:29, based on a comment received on the proposal to readopt the Noise Control Rules, N.J.A.C. 7:29, with amendments published in the New Jersey Register on December 20, 2010 (42 N.J.R. 3024(a)).\u00a0 The public comment period on the underlying proposal closed on February 18, 2011.\u00a0 The proposed substantial changes amend N.J.A.C. 7:29-1.2, Industrial, commercial, or community service facilities, to eliminate industrial facilities as a receptor for noise.\u00a0 As part of this change, the Department is proposing to add a new definition of electricity generation, change the definitions of community service facility and industrial facility, and delete the definition of public service facility at N.J.A.C. 7:29-1.1.\u00a0 The Department is also proposing to change N.J.A.C. 7:29-1.5, Exceptions, to remove references to public service facility.<\/p>\n
