{"id":1447,"date":"2021-11-18T09:44:23","date_gmt":"2021-11-18T14:44:23","guid":{"rendered":"https:\/\/deptest.nj.gov\/rules\/?page_id=1447"},"modified":"2023-08-01T11:55:04","modified_gmt":"2023-08-01T15:55:04","slug":"122004c","status":"publish","type":"page","link":"https:\/\/deptest.nj.gov\/rules\/notice-of-rule-proposal-archive\/122004c\/","title":{"rendered":"122004c"},"content":{"rendered":"<p><b>NJ DEPARTMENT of ENVIRONMENTAL PROTECTION<\/b><br \/>\nLand Use Management<br \/>\nWater Monitoring and Standards<\/p>\n<p><strong>Notice of Rule Proposal<\/strong><br \/>\nSurface Water Quality Standards N.J.A.C. 7:9B-1.15, Classification<br \/>\nand Antidegradation Upgrade of Shark River<\/p>\n<p><b>Public Notice<\/b><br \/>\nTake notice that the New Jersey Department of Environmental<br \/>\nProtection (Department) is proposing amendments of the Surface<br \/>\nWater Quality Standards (SWQS), N.J.A.C. 7:9B. The SWQS govern<br \/>\nthe protection and enhancement of surface water quality and<br \/>\nresources of the State of New Jersey. The rules include stream<br \/>\nclassifications (comprised of a use classification and an antidegradation<br \/>\ndesignation), policies (including antidegradation policies),<br \/>\nand water quality criteria for conventional and toxic pollutants<br \/>\napplicable to all of the surface waters of the State. The SWQS<br \/>\nare intended to aid the Department&#8217;s implementation of the New<br \/>\nJersey Pollutant Discharge Elimination System (NJPDES) rules<br \/>\nat N.J.A.C. 7:14A, Freshwater Wetlands Protection Act rules<br \/>\nat N.J.A.C. 7:7A, Flood Hazard Area Control Act at N.J.A.C.<br \/>\n7:13-4, Stormwater Management rules at N.J.A.C. 7:8, and Water<br \/>\nQuality Management Planning rules at N.J.A.C. 7:15.<\/p>\n<p>The Department is proposing to amend the SWQS at N.J.A.C. 7:9B-1.15(c)<br \/>\nto segment the non-tidal portion of Shark River from its source<br \/>\nto Remsen Mill Road and rename this segment as Shark River Brook.<br \/>\nIn addition, the Department is proposing to upgrade the antidegradation<br \/>\ndesignation of the Shark River Brook and its named and unnamed<br \/>\ntributaries from Category Two to Category One based on &#8220;exceptional<br \/>\nwater supply significance.&#8221; In addition, the Department<br \/>\nis proposing to delete the twofold fresh and saline use classifications,<br \/>\nFW2-TM\/SE1 and FW2-NT\/SE1 applicable to portions of the Shark<br \/>\nRiver Brook and Shark River based on the monitoring data available<br \/>\non the levels of salinity. As a result, the non tidal portion<br \/>\nof Shark River Brook from Route 33 to Remsen Mill Road is being<br \/>\nproposed for reclassification as freshwater (FW2) and the tidal<br \/>\nportion of the Shark River from Remsen Mill road to Atlantic<br \/>\nOcean is being proposed for reclassification as saline estuarine<br \/>\n(SE1). However, the use classifications based on the trout status<br \/>\n(FW2-TM and FW2-NT) applicable to the freshwater portion of<br \/>\nthe Shark River Brook remain the same.<\/p>\n<p>The proposal will be published in the New Jersey Register dated<br \/>\nDecember 20, 2004. <a href=\"https:\/\/nj.gov\/dep\/wms\/bears\/docs\/R4-C1SharkRiverProposal.pdf\"> View the proposal<\/a> on the Water Monitoring and Standards<br \/>\nweb site.<\/p>\n<blockquote><p>Comments should be submitted by February 18, 2005 to:<br \/>\nLeslie W.
