{"id":1368,"date":"2021-10-21T09:14:38","date_gmt":"2021-10-21T13:14:38","guid":{"rendered":"https:\/\/deptest.nj.gov\/rules\/?page_id=1368"},"modified":"2024-05-21T10:05:22","modified_gmt":"2024-05-21T14:05:22","slug":"20151019a","status":"publish","type":"page","link":"https:\/\/deptest.nj.gov\/rules\/notice-of-rule-proposal-archive\/20151019a\/","title":{"rendered":"20151019a"},"content":{"rendered":"<p><b>NJ DEPARTMENT of ENVIRONMENTAL PROTECTION<\/b><br \/>\nWATER RESOURCE MANAGEMENT<br \/>\nOFFICE OF WATER RESOURCE MANAGEMENT COORDINATION<\/p>\n<p><strong>Notice of Rule Proposal<\/strong><br \/>\nWater Quality Management Planning rules, N.J.A.C. 7:15<br \/>\nNew Jersey Pollutant Discharge Elimination System rules N.J.A.C. 7:14A-4.3<br \/>\nHighlands Water Protection and Planning Act Rules N.J.A.C. 7:38-1.1<\/p>\n<p><strong>PUBLIC NOTICE<\/strong><br \/>\n<u>Take notice<\/u> that the NJ Department of Environmental Protection is proposing a repeal and new rules at N.J.A.C. 7:15 and amendments to N.J.A.C. 7:14A-4.3 and 7:38-1.1.\u00a0 This proposed rule makes major modifications to the WQMP rules to streamline reviews, eliminate duplication of regulatory requirements between programs, and continues to implement the most comprehensive and environmentally protective water quality protection requirements in the nation.\u00a0 This proposal strikes the right balance between environmental protection and the promotion of economic growth.\u00a0 Specifically the proposed rules, if adopted, would:<\/p>\n<ul>\n<li>Provide for comprehensive planning of water quality infrastructure to better protect the environment long term;<\/li>\n<li>Limit where sewer systems can be located thus restricting denser development only to those areas that are not environmentally sensitive and where it is consistent with local zoning;<\/li>\n<li>Protect ground water quality by setting goals for nitrate dilution from septic systems;<\/li>\n<li>Be consistent with legislative intent as expressed in two legislative enactments;<\/li>\n<li>Provide counties and other planning entities with greater flexibility in preparing their water quality plans;<\/li>\n<li>Promote more cooperation between the Department and counties in finding solutions to water quality issues;<\/li>\n<li>Protect threatened and endangered species habitat and natural heritage sites while providing commonsense flexibility consistent with DEP\u2019s regulatory programs;<\/li>\n<li>Continue to allow approvals of sewer service area amendments, so long as they are consistent with environmental standards and local planning objectives;<\/li>\n<li>Advance greater coordination among various levels of government;<\/li>\n<li>Defer, when possible, to the Pinelands and Highlands plans concerning planning decisions in those regions; and<\/li>\n<li>Improve DEP\u2019s ability to resolve capacity issues at wastewater treatment plants.<\/li>\n<\/ul>\n<p>The proposal is scheduled to be published in the New Jersey Register dated October 19, 2015.\u00a0 A copy of the proposal is available from:\u00a0 the DEP website at <a href=\"https:\/\/deptest.nj.gov\/rules\/wp-content\/uploads\/sites\/70\/proposals\/20151019a.pdf\">https:\/\/deptest.nj.gov\/rules\/notice-of-rule-proposals\/<\/a> ; the Office of Water Resource Management Coordination, P.O.
