{"id":1122,"date":"2021-09-09T16:50:38","date_gmt":"2021-09-09T16:50:38","guid":{"rendered":"https:\/\/deptest.nj.gov\/rules\/?page_id=1122"},"modified":"2022-09-13T12:28:58","modified_gmt":"2022-09-13T16:28:58","slug":"20210405a","status":"publish","type":"page","link":"https:\/\/deptest.nj.gov\/rules\/notice-of-rule-proposal-archive\/20210405a\/","title":{"rendered":"20210405a"},"content":{"rendered":"<p><b>NJ DEPARTMENT of ENVIRONMENTAL PROTECTION<\/b><br \/>\nAIR QUALITY, ENERGY, AND SUSTAINABILITY<br \/>\nDIVISION OF CLIMATE, CLEAN ENERGY, AND RADIATION PROTECTION<br \/>\nAND<br \/>\nCOMMISSION ON RADIATION PROTECTION<\/p>\n<p><strong>Notice of Rule Proposal<\/strong><br \/>\nRadiation Protection Programs; Certification of Radon Testers and Mitigators<br \/>\nProposed Amendments: N.J.A.C. 7:28-27.1 and 27.2<br \/>\nProposed Repeal: N.J.A.C. 7:28-27<br \/>\nProposed New Rules: N.J.A.C. 7:28-27A<\/p>\n<p><strong>PUBLIC NOTICE<\/strong><br \/>\n<strong>Take notice <\/strong>that the NJ Department of Environmental Protection and the Commission on Radiation Protection are proposing new rules for Certification of Radon Testers and Mitigators at N.J.A.C. 7:28-27A, amendments to N.J.A.C. 7:28-27.1 and 27.2, and the proposed prospective repeal of N.J.A.C. 7:28-27.<\/p>\n<p>This proposed rulemaking represents a continuation of the Department\u2019s and Commission\u2019s efforts to prohibit and prevent unnecessary radiation.\u00a0 The existing rules at N.J.A.C. 7:28-27 govern the certification of individuals and businesses who test for and mitigate radon.\u00a0 The proposed rules establish a new certification program that is based on an affiliate relationship between the certified business and certified individual; update the testing and mitigation protocols to the most recent science; discontinue the mitigation technician category for certification (after a period of time to allow existing mitigation technicians to apply for certification as mitigation specialists); and amend the experience and education requirements for other certification categories.\u00a0 The proposed rules also require out-of-State businesses to pay the Department inspectors\u2019 costs associated with travel to conduct inspections.<\/p>\n<p>The proposal is scheduled to be published in the New Jersey Register dated April 5, 2021.\u00a0 A copy of the proposal is available on the Department\u2019s website at <a href=\"https:\/\/deptest.nj.gov\/rules\/wp-content\/uploads\/sites\/70\/proposals\/20210405a.pdf\" target=\"_blank\" rel=\"noopener\">https:\/\/deptest.nj.gov\/rules\/wp-content\/uploads\/sites\/70\/proposals\/20210405a.pdf<\/a>, and LexisNexis free public access to the New Jersey Register (<a href=\"https:\/\/www.lexisnexis.com\/hottopics\/njoal\" target=\"_blank\" rel=\"noopener\">https:\/\/www.lexisnexis.com\/hottopics\/njoal<\/a>).<\/p>\n<p>A public hearing concerning the proposal will be conducted virtually via the Department\u2019s video conferencing software on Wednesday, May 5, 2021, at 9:00 A.M.\u00a0 A link to the virtual public hearing will be provided on the Department\u2019s Radon Section website at <a href=\"https:\/\/www.njradon.org\/\">https:\/\/www.njradon.org\/<\/a>.<\/p>\n<p>The Department encourages electronic submittal of comments.
