Program Regulation<\/h2>\n

The CO\u2082 Budget Trading Rule applies to all grid supply fossil fuel electric generating units with a nameplate capacity of 25 megawatts (MW) or greater that commenced operation on January 1, 2005, or later. For the RGGI program, regulation is applied at the electric generation unit basis (EGU), or CO\u2082 budget source. It is common for a single power plant facility to consist of multiple EGUs. While these units are often part of larger facilities with compliance obligations\u2014including monitoring, reporting, and holding allowances for regulatory compliance\u2014their specific requirements apply to the individual units themselves.<\/p>\n

To maintain compliance to the regulation, the CO\u2082 budget source\u2019s Title V operating permit must contain all applicable requirements of the CO\u2082 budget program, including monitoring, record keeping and reporting.<\/p>\n

All regulated entities must submit the \u201cRGGI Certificate of Representation Form<\/a>\u201d <\/i> to the U.S. EPA Clean Air Markets Data Program which will be reflected in the RGGI CO\u2082 Allowance Tracking System (COATS).[\/vc_column_text][\/vc_column][\/vc_row][vc_row][vc_column][vc_column_text css=””]<\/p>\n

Program Management<\/h2>\n

The Department\u2019s Air, Energy, and Materials Sustainability Program reviews and approves all permit applications and revisions. The Bureau of Climate Change and Clean Energy (BCCCE) manages the program implementation, coordinates with RGGI, Inc. on the auction requirements and monitoring, and oversees the investment of auction proceeds.<\/p>\n

Program Requirements<\/h2>\n

New Jersey\u2019s RGGI rule requires the following from regulated entities:<\/p>\n

Application for adding CO\u2082\u00a0Budget Source in Operating Permit<\/i><\/b><\/p>\n

Consistent with N.J.A.C. 7:27C-3.3, a CO\u2082\u00a0budget source must submit NJ03-APPLICATION FOR ADDING A CO2 BUDGET SOURCE IN OPERATING PERMIT<\/a> <\/i>, along with a complete application for a new, renewed, or modified operating permit.<\/p>\n

Compliance Plan<\/i><\/b><\/p>\n

Consistent with N.J.A.C. 7:27C-8, the CO\u2082 budget source and each CO\u2082 budget unit at the source must comply with the monitoring, record keeping, and reporting requirements of the CO\u2082\u00a0Budget Trading Program at N.J.A.C. 7:27C, as applicable. Pursuant to N.J.A.C. 7:27-22.28, the Department will incorporate these requirements into the facility\u2019s operating permit using the Compliance Plan Template<\/a> <\/i>.<\/p>\n
