This law also holds propulsion battery producers responsible for the end-of-life management of their batteries. Under the law, the producer is responsible for any used propulsion battery they produced if it is offered back to them by the current battery owner. The law requires these producers to develop and implement battery management plans that provide for battery reuse, repurpose, and recycling.<\/p>\n<p class=\"text-center\"><a class=\"btn btn-primary\" role=\"button\" href=\"https:\/\/pub.njleg.state.nj.us\/Bills\/2022\/PL23\/222_.PDF\">Electric and Hybrid Battery Management Act <i class=\"fas fa-file-pdf text-danger\" title=\"Adobe Acrobat PDF file\"><\/i><\/a><\/p>\n<p>[\/vc_column_text][vc_tta_accordion color=&#8221;white&#8221; spacing=&#8221;1&#8243; gap=&#8221;2&#8243; c_icon=&#8221;chevron&#8221; c_position=&#8221;right&#8221; active_section=&#8221;-1&#8243; collapsible_all=&#8221;true&#8221;][vc_tta_section title=&#8221;What is a Propulsion Battery?&#8221; tab_id=&#8221;propulsion-battery&#8221;][vc_column_text css=&#8221;&#8221;]A propulsion battery is defined as an electrical energy storage device consisting of one or more individual battery modules or battery cells, which are used to supply power to propel an electric or hybrid road vehicle. &#8220;Propulsion battery&#8221; includes, but is not limited to, lithium-ion batteries and nickel-metal hydride batteries and includes batteries that have been removed from a vehicle or are still embedded in a vehicle. &#8220;Propulsion battery&#8221; does not include a starter battery or a battery used for, or embedded in, products for industrial applications.[\/vc_column_text][\/vc_tta_section][vc_tta_section title=&#8221;What are Battery Management Plans?&#8221; tab_id=&#8221;battery-management-plans&#8221;][vc_column_text css=&#8221;&#8221;]A battery management plan is a plan for the collection, transportation, remanufacturing, reuse, recycling and disposal of used propulsion batteries. Under a battery management plan, the producer is responsible for any used propulsion battery they produced when it is offered back to them by the current battery owner.<\/p>\n<p>Plans must use environmentally sound management practices, which are the policies and procedures implemented by the producer that will:<\/p>\n<ul>\n<li>Ensure compliance with all applicable federal, state, and local laws, rules, regulations, and ordinances<\/li>\n<li>Protect human health, safety, and the environment<\/li>\n<li>Provide for the adequate recordkeeping, tracking, and documentation of the disposal of used propulsion batteries within New Jersey<\/li>\n<\/ul>\n<p>The DEP will develop rules to provide the standards that will be used in evaluating battery management plans. The DEP will begin the rulemaking process after the needs assessment (see below) is completed.\u00a0 All propulsion battery producers will be required to submit a battery management plan to the DEP within 180 days after the date rules are adopted. After that, every battery management plan must be reviewed and updated, as necessary, at least once every five years.<\/p>\n<p>A producer may submit a plan individually or may join a producer responsibility organization (PRO), which can submit one plan for a group of producers.<\/p>\n<p>Approved battery management plan(s) will be accessible on this website and will include a list identifying each of the producers participating in the plan.<\/p>\n<p>A battery management plan will need to include, at a minimum:<\/p>\n<ol>\n<li>The methods that will be used to accept, collect, and transport used propulsion batteries or vehicles offered back to the producer.<\/li>\n<li>The processes and methods that will be utilized to remanufacture, repurpose, or recycle used propulsion batteries pursuant to environmentally sound management practices. including the identity of recyclers and a plan for final disposal of used propulsion batteries.<\/li>\n<li>A strategy for informing electric vehicle owners, vehicle repair facilities, and vehicle dismantlers in New Jersey about the requirement to properly manage propulsion batteries, the environmental impact of the improper handling or disposal of used propulsion batteries, and the mechanisms for the management of propulsion batteries that are available pursuant to the plan.<\/li>\n<li>How the plan will be implemented and financed by the producer.<\/li>\n<\/ol>\n<p>The producer will be responsible for all costs associated with the collection, transportation, remanufacturing, reuse, recycling, and disposal of used propulsion batteries.<br \/>\n[\/vc_column_text][\/vc_tta_section][vc_tta_section i_icon_fontawesome=&#8221;fas fa-exclamation-circle&#8221; add_icon=&#8221;true&#8221; title=&#8221;Registration&#8221; tab_id=&#8221;registration-pdf&#8221;][vc_column_text css=&#8221;&#8221;]A producer of a propulsion battery, whether embedded in a vehicle or sold outside of a vehicle, is required to register with the DEP. The annual report must reflect sales and distribution data from the prior calendar year. For example, annual reports submitted in 2026 should reflect sales and distribution data from 2025.<\/p>\n<p>The DEP has developed the Producer Annual Reporting Form Version 2.0, which producers must submit to be in compliance with the annual reporting requirement in 2026. Producers should ensure they are using Version 2.0 when completing and submitting their form. Older versions of the form will not be accepted.<\/p>\n<p>Annual reports will be accepted from January 8, 2026 through April 30, 2026.<\/p>\n<p>To review and complete the annual reporting requirements, please download the Producer Annual Reporting Form below. Producers can submit completed forms along with any questions they may have to <a href=\"mailto:evbatteries@deptest.nj.gov\">evbatteries@deptest.nj.gov<\/a>.[\/vc_column_text][info-box-shortcode icon=&#8221;fa fa-regular fa-file-excel&#8221; buttontitle=&#8221;Download Form&#8221; buttonlink=&#8221;https:\/\/deptest.nj.gov\/dshw\/wp-content\/uploads\/sites\/133\/ev-battery-annual-reporting-form-v2.xlsb&#8221; targetlink=&#8221;true&#8221;][\/info-box-shortcode][\/vc_tta_section][vc_tta_section title=&#8221;Battery Labeling&#8221; tab_id=&#8221;battery-labeling&#8221;][vc_column_text css=&#8221;&#8221;]Beginning on January 1, 2027, the Electric and Hybrid Vehicle Battery Management Act requires all propulsion batteries sold in New Jersey, whether they are embedded in a vehicle or not, to include a permanent label that provides information about the battery. The NJDEP must provide the requirements for these battery labels via rules and regulations. However, the NJDEP believes that battery labeling requirements should be included as part of its overall future rulemaking for battery management plans, and the NJDEP cannot adopt rules for battery management plans until after the needs assessment has been completed. Because the needs assessment is still pending, the NJDEP is not requiring permanent labels to be included on propulsion batteries sold in the state until rulemaking is completed.[\/vc_column_text][\/vc_tta_section][vc_tta_section title=&#8221;Needs Assessment&#8221; tab_id=&#8221;needs-assessment&#8221;][vc_column_text css=&#8221;&#8221;]A needs assessment is required by the law to determine the availability of authorized propulsion battery recyclers and related infrastructure, both public and private, needed to implement the provisions of the law.<\/p>\n<p>The DEP has made funding available through the Solid Waste Recycling Enhancement Act (REA) Higher Education Research Grant Program to execute the required needs assessment pursuant to N.J.S.A. 13:1E-99.81d. Institutions of higher education located in New Jersey are eligible to apply for this funding; however, private vendors are welcome to partner with eligible institutions.
