DEP Blue Acres evaluates storm-impacted and flood-prone communities throughout the state on an ongoing basis. Any area or neighborhood that meets these criteria is eligible for Blue Acres assistance, regardless of whether the flooding is coastal or inland. Keep in mind that federal buyout funding can be more selective, and typically available to only specific geographies. For example, FEMA’s Flood Mitigation Assistance (FMA) program funding is available only within communities participating in, and in good standing with, the National Flood Insurance Program (NFIP).[/vc_toggle][vc_toggle title=”What properties are eligible?” css=””]Currently, only privately-owned residential properties are eligible for the buyout program. Blue Acres continues to work with state and local officials to proactively reduce flood risk and the inequities that adversely affect the communities most vulnerable to climate change. All homeowners must be willing sellers, and there is no requirement for clusters or neighborhood-wide participation for Blue Acres buyouts.

Blue Acres will notify local governments if properties within their jurisdiction are eligible, upon request.[/vc_toggle][vc_toggle title=”Will it cost my municipality to participate in flood mitigation via State-led buyouts?” css=””]The administrative costs to implement buyouts are covered by DEP in most cases; this includes the purchase cost of the buyout property, costs of property appraisals, other due diligence work such as environmental reviews, and demolitions. The es.

Once a property’s deed has been transferred to DEP, the State of New Jersey (the State) retains legal ownership. DEP encourages local governments to take an active role in stewarding these newly-created open spaces . The financial responsibilities associated with maintaining buyout land are the only costs a municipality will directly incur. The municipality will be asked to enter into a Memorandum of Understanding with the State of New Jersey that will specify maintenance, insurance, and other requirements.

Blue Acres welcomes partnerships with local environmental groups and nonprofits to maintain and steward the buyout open space areas. Before the local government makes any changes or improvements to the buyout open space land, they must request and obtain approval through the State of New Jersey. During this time, Blue Acres depends on partnership with the municipality to oversee the property while it is vacant. Keys to the property will be provided and any issues should be reported to the police department or municipal leadership. Any illegal activity on State-owned land should be reported to the police department and/or code enforcement office.

Sign Installation: After demolition, the land is regraded and reseeded. The Blue Acres sign should be installed* at the property to notify the public that the land is preserved open space for flood storage. Just as with any other park area within the municipality, local governments help prevent illegal encroachments to the land through regular oversight. *Signs will be installed on most properties after demolition. For existing buyout properties that do not have signs installed, please reach out to blueacres@deptest.nj.gov to request a sign.

Routine maintenance: The municipality serves as the day-to-day manager of the preserved open space area. Some examples of routine maintenance include but are not limited to: Keeping vegetation maintained (such as mowing grass or trimming hazardous tree branches as needed), clearing sidewalks of snow as applicable, removing trash if any receptacles are on-site, and ensuring neighboring landowners are not encroaching on the preserved open space areas.

Future use planning: Blue Acres encourages local governments to engage the community in creating plans to enhance the use of former buyout sites—such as passive recreation improvements or flood-risk reduction projects. The Floodplain Restoration section of the Blue Acres website has examples of how other municipalities transformed former buyout areas into vital open spaces.

[/vc_toggle][vc_toggle title=”What can local governments do with the land?” css=””]Blue Acres properties are designated as “preserved open space for flood storage,” meaning the land can only be used for passive recreation, wetlands, wildlife habitat, or flood storage purposes. Here are a few examples:

In Rahway, the municipality passed a resolution to formally name the Blue Acres buyout area in honor of a former councilman and Vietnam veteran. A dedication ceremony was held at the site to name the park, and it remains a passive recreation area for the community.

In Medford, the municipality received DEP approval to install a boat ramp along a waterfront Blue Acres open space area.

In Sayreville, the municipality has established no-mow zones that are left in their natural state to enable the establishment of meadows that support wildlife and pollinators on buyout lands. Signs are posted around the area to educate the community about the no-mow area that allows for meadow establishment.

In New Milford, the municipality installed decorative boulders along the roadway and property line of the buyout area. The boulders provide a demarcation of the park area and deter nearby residents from encroaching on the land.

Looking for more information about how buyout lands are being restored to increase flood resilience?
