These commonly found air pollutants (also known as \u201ccriteria pollutants\u201d) are particle pollution or particulate matter (PM), ground-level ozone, carbon monoxide (CO), sulfur dioxide (SO<sub>2<\/sub>), nitrogen dioxide (NO<sub>2<\/sub>), and lead. These pollutants can harm your health, the environment, and cause property damage. The USEPA calls these pollutants \u201ccriteria\u201d air pollutants because it regulates them by developing human health-based and\/or environmentally-based criteria (science-based guidelines) for setting permissible levels. Limits based on human health are called primary standards. The USEPA also can establish a second set of limits intended to prevent environmental and property damage, which are referred to as secondary standards. The Federal Clean Air Act further requires the USEPA to review and, if appropriate, revise the NAAQS for each criteria air pollutant every five years to ensure they continue to adequately protect human health and welfare. For more information on the criteria pollutants, see the\u00a0<a href=\"https:\/\/www.epa.gov\/criteria-air-pollutants\/naaqs-table\" target=\"_blank\" rel=\"noopener\">USEPA\u2019s NAAQS website<\/a>\u00a0at\u00a0<a href=\"https:\/\/www.epa.gov\/criteria-air-pollutants\/naaqs-table\" target=\"_blank\" rel=\"noopener\">https:\/\/www.epa.gov\/criteria-air-pollutants\/naaqs-table<\/a>.<\/p>\n<p>When a NAAQS is established or revised, USEPA goes through a formal process to designate all areas of the country as either in attainment or in nonattainment. Based on the Federal Clean Air Act, USEPA further classifies ozone, carbon monoxide, and particulate matter nonattainment areas based on the magnitude of an area\u2019s ambient air pollution. Nonattainment classifications may be used to specify what air pollution reduction measures an area must adopt and when the area must reach attainment. The technical details underlying these classifications are discussed in the Code of Federal Regulations, Part 81 (40 CFR 81). \u00a0Certain areas designated as nonattainment for a criteria pollutant (such as areas classified as moderate and above for ozone) must develop plans that show how they will bring those areas into attainment of the standard by their designated attainment dates. Once an area meets its attainment date, it can be redesignated to attainment by submitting maintenance plans for these areas to USEPA to ensure continued attainment of the area over two consecutive 10 year periods. The redesignated areas are referred to as \u201cmaintenance areas.\u201d The USEPA Green Book provides detailed information about area NAAQS\u00a0designations, classifications and nonattainment status at the following website:\u00a0<a href=\"https:\/\/www.epa.gov\/green-book\" target=\"_blank\" rel=\"noopener\">https:\/\/www.epa.gov\/green-book<\/a>.<\/p>\n<h5>What is a Design Value?<\/h5>\n<p>A design value is a statistical analysis of ambient air quality monitoring data calculated to determine compliance with the NAAQS. \u00a0The design value definitions vary among the different NAAQS. Design Values are also used by USEPA to designate and classify nonattainment areas.\u00a0 More information on design values can be found\u00a0<a href=\"https:\/\/www.epa.gov\/air-trends\/air-quality-design-values\" target=\"_blank\" rel=\"noopener\">here<\/a>. In some cases, the design value for a NAAQS is set in such a way that attainment or nonattainment cannot be determined based on a single year or a single exceedance event.\u00a0 For example, under the current standard for ozone, the design value is calculated by taking the average of the fourth highest daily maximum 8-hour average concentration that is recorded each year for three years. Attainment of the NAAQS is achieved when the design value is at or below the NAAQS.[\/vc_column_text][\/vc_column][vc_column][\/vc_column][\/vc_row][vc_row][vc_column][vc_custom_heading text=&#8221;New Jersey Attainment Area Status&#8221; font_container=&#8221;tag:h2|text_align:center&#8221; use_theme_fonts=&#8221;yes&#8221;][vc_tta_accordion style=&#8221;flat&#8221; color=&#8221;peacoc&#8221; gap=&#8221;1&#8243; c_icon=&#8221;chevron&#8221; active_section=&#8221;-1&#8243; no_fill=&#8221;true&#8221; collapsible_all=&#8221;true&#8221;][vc_tta_section title=&#8221;1-Hour Ozone NAAQS (Revoked)&#8221; tab_id=&#8221;one-hour-ozone-naaqs-revoked&#8221;][vc_row_inner css=&#8221;.vc_custom_1600456049080{background-color: #ffffff !important;}&#8221;][vc_column_inner width=&#8221;1\/2&#8243;][vc_column_text css=&#8221;&#8221;]In 1979, the USEPA established a 1-hour ozone standard of 0.12 parts per million (ppm). Under the 1-hour ozone standard, the entire State of New Jersey was designated as nonattainment. There were three multi-state nonattainment areas and a New Jersey-only nonattainment area for the 1-hour NAAQS. The first multi-state area was the Philadelphia-Wilmington-Trenton Nonattainment Area, which consisted of Burlington, Camden, Cumberland, Gloucester, Mercer, and Salem Counties in New Jersey. The second multi-state area was the New York-Northern New Jersey-Long Island Nonattainment Area, which consisted of Bergen, Essex, Hudson, Hunterdon, Middlesex, Morris, Monmouth, Ocean, Passaic, Somerset, Sussex, and Union Counties in New Jersey. The third multi-state area was the Allentown-Bethlehem-Easton Nonattainment Area, which consisted of Warren County in New Jersey. The New Jersey-only nonattainment area was the Atlantic City Nonattainment Area, which consisted of Atlantic and Cape May Counties.<\/p>\n<p>On June 15, 2005, the 1-hour ozone standard was revoked for all areas except the 8-hour ozone nonattainment Early Action Compact Areas (EAC) in accordance with 40 CFR 50.9(b).\u00a0 New Jersey did not have any EAC areas or areas that had deferred effective dates for their designations under the 8-hour ozone standard. \u00a0Due to the revocation of the 1-hour ozone standard, effective June 15, 2005, Federal Register 70 FR 44470 removed from 40 CFR part 81 the 1-hour designations and classifications for all areas (except EAC areas).\u00a0 The former 1-hour ozone designations and classifications as of June 15, 2004 were retained in subpart C of Part 81 for purposes of the anti-backsliding provisions of 40 CFR 51.905. 40 CFR 51.905(c) references subpart C of part 81 for the areas affected by the anti-backsliding regulation. The anti-backsliding provision is in place to prevent areas from undoing any air quality improvement measures or to make sure areas keep their commitments to improving air quality in their federally approved state implementation plans (SIPs).<\/p>\n<p>A summary of New Jersey\u2019s nonattainment counties and corresponding classifications is shown below.\u00a0 For more information on the 1-hour ozone NAAQS and designations, see USEPA\u2019s website at\u00a0<a href=\"https:\/\/www.epa.gov\/criteria-air-pollutants\/naaqs-table\" target=\"_blank\" rel=\"noopener\">https:\/\/www.epa.gov\/criteria-air-pollutants\/naaqs-table<\/a>\u00a0and<u>\u00a0<\/u><a href=\"https:\/\/www.epa.gov\/green-book\" target=\"_blank\" rel=\"noopener\">https:\/\/www.epa.gov\/green-book<\/a>.[\/vc_column_text][\/vc_column_inner][vc_column_inner width=&#8221;1\/2&#8243;][vc_single_image image=&#8221;3013&#8243; img_size=&#8221;large&#8221; onclick=&#8221;link_image&#8221;][\/vc_column_inner][\/vc_row_inner][\/vc_tta_section][vc_tta_section title=&#8221;8-Hour Ozone NAAQS&#8221; tab_id=&#8221;eight-hour-ozone-naaqs&#8221;][vc_row_inner css=&#8221;.vc_custom_1600456220133{background-color: #ffffff !important;}&#8221;][vc_column_inner width=&#8221;1\/2&#8243;][vc_column_text css=&#8221;&#8221;]In 1997, the USEPA established an 8-hour ozone standard of 0.08 parts per million (84 parts per billion(ppb)).<\/p>\n<p>On April 30, 2004, the USEPA finalized attainment\/nonattainment designations for the 1997 8-hour ozone NAAQS. The entire state of New Jersey was designated into two multi-state nonattainment areas, the New York-Northern New Jersey-Long Island (NJ-NY-CT) Nonattainment Area and the Philadelphia-Wilmington-Atlantic City (NJ-PA-DE-MD) Nonattainment Area. The 1997 8-hour ozone NJ-NY-CT Nonattainment Area includes the New Jersey counties of: Bergen, Essex, Hudson, Hunterdon, Middlesex, Monmouth, Morris, Passaic, Somerset, Sussex, Union, and Warren. The 1997 8-hour ozone NJ-PA-DE-MD Nonattainment Area includes the New Jersey counties of: Atlantic, Burlington, Camden, Cape May, Cumberland, Gloucester, Mercer, Ocean, and Salem.\u00a0 Ocean county, New Jersey was in New Jersey&#8217;s northern nonattainment area for the 1-hour ozone standard, but was moved to New Jersey&#8217;s southern nonattainment area for the 1997 8-hour ozone NAAQS\u00a0at New Jersey&#8217;s request.<\/p>\n<p>On March 12, 2008, the USEPA revised the 8-hour ozone NAAQS. The primary 8-hour ozone standard was lowered from 84 ppb to 0.075 ppm (75 ppb). The secondary standard was also lowered to make it equal to the primary standard.<\/p>\n<p>On April 1, 2009, New Jersey submitted recommendations for designating nonattainment areas for the 2008 revised ozone standard to USEPA. The USEPA announced on\u00a0<a href=\"https:\/\/deptest.nj.gov\/airplanning\/wp-content\/uploads\/sites\/83\/attainment-area-status\/EPA-8-Hr-Ozone-Reconsideration-9-16-2009.pdf\">September 16, 2009<\/a>\u00a0that the 75 ppb standard was being reconsidered, and the designations were stayed (put on hold). See New Jersey\u2019s submission to the USEPA at\u00a0<a href=\"https:\/\/deptest.nj.gov\/airplanning\/wp-content\/uploads\/sites\/83\/attainment-area-status\/NJ-2008-Ozone-Designation-Recommendation.pdf\">click here<\/a>.<\/p>\n<p>On January 6, 2010, USEPA proposed to strengthen the 8-hour ozone NAAQS set in March 2008 to a level within the range of 0.060-0.070 ppm. The USEPA also proposed establishment of a distinct cumulative, seasonal \u201csecondary\u201d standard, designed to protect sensitive vegetation and ecosystems, including forests, parks, wildlife refuges and wilderness areas within the range of 7-15 ppm-hours.\u00a0 In September of 2011, USEPA announced it would not adopt its proposed ozone NAAQS and that it would instead proceed with implementation of the 2008 75 ppb 8-hour standard.<\/p>\n<p>Both of New Jersey\u2019s nonattainment areas attained the 84 ppb standard by the attainment date of June 15, 2010 (the southern area received a 1-year extension with a new attainment date of June 15, 2011).<\/p>\n<p>On March 26, 2012 the USEPA issued a clean data determination (CDD) for the 1997 84 ppb 8-hour ozone standard for the Southern NJ-PA-DE-MD Nonattainment Area and on June 18, 2012, for the Northern NJ-NY-CT Nonattainment Area, suspending the States obligations to meet certain attainment-related planning requirements under the USEPA\u2019s Clean Data Policy dated December 14, 2004, such as reasonable available control measures (RACM), reasonable further progress, contingency measures and other planning requirements related to attainment, as long as the area continues to attain.<\/p>\n<p>On May 21, 2012, the USEPA designated the entire state of New Jersey as nonattainment for the 0.075 ppm 8-hour ozone NAAQS.\u00a0 While New Jersey\u2019s nonattainment areas remained the same as those designated for the 84 ppb standard, Delaware\u2019s portion of the nonattainment area changed to only include New Castle County.<\/p>\n<p>In April 2015, USEPA issued regulations regarding the implementation of the revised NAAQS (2008 ozone SIP Requirements Rule). In that rule, the USEPA revoked the 1997 ozone NAAQS and established requirements to ensure that progress toward clean air would not \u201cbackslide.\u201d USEPA also stated that it would no longer make determinations of attainment by the attainment date except to trigger relevant anti-backsliding obligations, as the designations and classifications for 1997 ozone NAAQS areas were revoked along with the standard.<\/p>\n<p>On October 26, 2015, the USEPA again revised the 8-hour ozone NAAQS. The primary and secondary 8-hour ozone standards were lowered from 75 ppb to 70 ppb.<\/p>\n<p>On September 29, 2016, New Jersey submitted recommendations for designating nonattainment areas for the 2015 ozone standard to the USEPA.\u00a0 See New Jersey \u2019s submission to the USEPA at\u00a0<a href=\"https:\/\/deptest.nj.gov\/airplanning\/wp-content\/uploads\/sites\/83\/attainment-area-status\/ozone-designation-recommendation-9-29-16.pdf\">click here<\/a>.<\/p>\n<p>On May 4, 2016, the CDD for the NJ-NY-CT Nonattainment Area, issued in June 2012, was rescinded. USEPA determined that the area exceeded the 84 ppb standard based on 2010-2012 certified monitoring data and issued a SIP Call. USEPA required the NJ-NY-CT Nonattainment Area to submit a SIP to address the 84 ppb standard exceedance either specific to the 84 ppb standard or in conjunction with the 75 ppb standard attainment demonstration moderate area SIP and set a new attainment date of July 20, 2018.<\/p>\n<p>On December 22, 2017, New Jersey submitted a SIP revision showing that the NJ-NY-CT Nonattainment Area is in compliance with the 1997 84 ppb 8-hour ozone NAAQS and satisfying the May 4, 2016, SIP Call.<\/p>\n<p>On June 4, 2018, the USEPA designated the entire state of New Jersey as nonattainment for the 70 ppb 8-hour ozone NAAQS. The nonattainment areas are the same as those designated for the 84 ppb and 75 ppb standards.<\/p>\n<p>On September 2, 2021. USEPA approved NJ\u2019s December 22, 2017, SIP revision showing that the NJ-NY-CT Nonattainment Area is in compliance with the 1997 84 ppb 8-hour ozone NAAQS.SIP<\/p>\n<p>On January 15, 2026, New Jersey submitted a request to USEPA to revise the NJ-NY-CT Nonattainment Area boundaries for the 2008 75 ppb and 2015 70 ppb 8-hour Ozone NAAQS in accordance with Clean Air Act (CAA) 107(d)(3)(D).\u00a0 New Jersey\u2019s request is for the NAA to be split into two distinct nonattainment areas, in which the New Jersey portion of the NAA would encompass one nonattainment area and the remaining counties in New York and Connecticut would encompass the other nonattainment area. The proposed separate nonattainment areas would cover the identical geographic area as the existing nonattainment area, and both areas would retain their current nonattainment designations and 1997, the USEPA established annual and 24-hour NAAQS for PM2.5 for the first time. The NAAQS were set at 15 \u00b5g\/m<sup>3<\/sup> for the annual standard and 65 \u00b5g\/m<sup>3<\/sup> for the 24-hour standard. Thirteen of New Jersey \u2019s 21 counties were designated as nonattainment for the 1997 annual standard, and were associated with two multi-state nonattainment areas, the Northern New Jersey-New York- Connecticut (NNJ-NY-CT) Nonattainment Area and the Southern New Jersey-Philadelphia (SNJ-PA-DE) Nonattainment Area. \u00a0New Jersey counties that were in the NNJ-NY-CT Nonattainment Area are Passaic, Bergen, Morris, Essex, Hudson, Union, Somerset, Middlesex, Monmouth, and Mercer Counties. New Jersey counties that were in the SNJ-PA-DE Nonattainment Area are Burlington, Camden, and Gloucester Counties.<\/p>\n<p>In 2006, the USEPA revised the 24-hour NAAQS for PM2.5 from 65 \u00b5g\/m<sup>3<\/sup> to 35 \u00b5g\/m<sup>3<\/sup>. \u00a0The State submitted its recommendation of nonattainment areas in New Jersey to the USEPA on December 18, 2007. On August 19, 2008, the USEPA responded to state designation recommendations and proposed area designations for the 35 \u00b5g\/m<sup>3<\/sup> 24-hour PM2.5 NAAQS. On December 22, 2008, the USEPA signed a notice on the final designations, but it was not published in the Federal Register due to the change in Federal Administration, which required that all rules not yet finalized would undergo review before being released. On October 8, 2009, the designations were finalized and published in the\u00a0<a href=\"https:\/\/deptest.nj.gov\/airplanning\/wp-content\/uploads\/sites\/83\/attainment-area-status\/PM25_24Hr_Designations_FR_Final.pdf\" target=\"_blank\" rel=\"noopener\">Federal Register on November 13, 2009.\u00a0<\/a>The New Jersey nonattainment areas for the 24-hour 35 \u00b5g\/m<sup>3<\/sup> standard were the same as for the annual 15 \u00b5g\/m<sup>3<\/sup> standard.<\/p>\n<p>In\u00a0<a href=\"https:\/\/deptest.nj.gov\/airplanning\/state-implementation-plans-sips\/fine-particle-pm2-5-sip-2012\/\">December of 2012<\/a>, New Jersey submitted a request for redesignation to attainment of the annual 15 \u00b5g\/m<sup>3<\/sup> and 24-hour 35 \u00b5g\/m<sup>3<\/sup> standards to the USEPA. On August 13, 2013, the USEPA redesignated New Jersey\u2019s 13 nonattainment counties to attainment\/maintenance for the annual 15 \u00b5g\/m<sup>3<\/sup> and the 24-hour 35 \u00b5g\/m<sup>3<\/sup> PM2.5 NAAQS, effective\u00a0<a href=\"https:\/\/deptest.nj.gov\/airplanning\/wp-content\/uploads\/sites\/83\/attainment-area-status\/PM2.5RedesignationFinalApproval.pdf\" target=\"_blank\" rel=\"noopener\">September 4, 2013.<\/a><\/p>\n<p>On December 14, 2012, the USEPA revised the annual NAAQS for PM2.5 from 15 \u00b5g\/m<sup>3<\/sup> to 12 \u00b5g\/m<sup>3<\/sup>, while retaining the secondary annual NAAQS at 15 \u00b5g\/m<sup>3<\/sup>. On January 15, 2015, USEPA designated New Jersey as unclassifiable\/attainment for the 2012 annual 12 \u00b5g\/m<sup>3<\/sup> PM2.5 NAAQS.<\/p>\n<p>On February 7, 2024, the USEPA revised the primary annual NAAQS for PM2.5 from 12 \u00b5g\/m<sup>3<\/sup> to 9 \u00b5g\/m<sup>3<\/sup>, while retaining the secondary annual standard at 15 \u00b5g\/m<sup>3<\/sup> and also retaining the primary and secondary daily standard of 35 \u00b5g\/m<sup>3<\/sup>. Although New Jersey was designated as attainment in 1988, portions of Warren County, New Jersey were designated nonattainment at New Jersey\u2019s request consistent with modeling at the time.<\/p>\n<p>In 1973, the secondary 3-hour SO<sub>2<\/sub>\u00a0standard was retained without revision and the secondary annual SO<sub>2<\/sub>\u00a0standard was revoked.<\/p>\n<p>In 1996, the existing primary SO<sub>2<\/sub>\u00a0standards were retained, without revision.<\/p>\n<p>On June 22, 2010, the USEPA established a 1-hour SO<sub>2<\/sub>\u00a0standard at 75 parts per billion (ppb).\u00a0 The primary annual and 24-hour SO<sub>2<\/sub>\u00a0standards were revoked for all areas one year after designations under the 2010 primary NAAQS were final, except for areas previously designated nonattainment that did not have an approved SIP for the new 1-hour standard. The 3-hour secondary NAAQS remained in effect. On January 22, 2010, the USEPA established a new 1-hour NO<sub>2<\/sub> standard at 100 parts per billion (ppb) and retained the current annual average NO<sub>2<\/sub> standard of 53 ppb. To determine compliance with the new standard, the USEPA established new ambient air monitoring and reporting requirements for NO<sub>2<\/sub> by requiring NO<sub>2<\/sub> monitors to be sited near roads in certain urban areas.<\/p>\n<p>On February 11, 2011, New Jersey submitted its\u00a0<a href=\"https:\/\/deptest.nj.gov\/airplanning\/wp-content\/uploads\/sites\/83\/attainment-area-status\/NO2-Recommendations-2-11-2011.pdf\" target=\"_blank\" rel=\"noopener\">recommendations for NO<sub>2<\/sub> designations<\/a>\u00a0to the USEPA. 1978, the USEPA established a lead NAAQS as a quarterly average standard set at 1.5 \u00b5g\/m<sup>3<\/sup>.\u00a0 The State was designated as attainment for the 1.5 \u00b5g\/m<sup>3<\/sup> lead standard.<\/p>\n<p>On October 15, 2008, the USEPA revised the lead NAAQS and established it as a rolling 3-month average (maximum) not to exceed 0.15 \u00b5g\/m<sup>3<\/sup> over a 3-year period. \u00a0On October 15, 2009, New Jersey submitted its\u00a0<a href=\"https:\/\/deptest.nj.gov\/airplanning\/wp-content\/uploads\/sites\/83\/attainment-area-status\/Lead-Designation-10-15-and-11-23.pdf\" target=\"_blank\" rel=\"noopener\">recommendations for lead designations<\/a>\u00a0to the USEPA.<\/p>\n<p>On December 14, 2010, the USEPA lowered the lead emissions monitoring threshold from 1.0 tons per year (tpy) to 0.50 tpy (except for airports) and required lead monitoring at NCore Network sites instead of the current requirement to place lead monitors in each Core Based Statistical Area with a population of 500,000 or more people.<\/p>\n<p>On November 22, 2011, New Jersey was designated by the USEPA as unclassifiable\/attainment for the 0.15 \u00b5g\/m<sup>3<\/sup> standard.<\/p>\n<p>On
